A relationship ends, one person wants to move out and the other initially stay. Organisationally the solution seems simple: split the keys, collect furniture, redistribute payments. However, the existing tenancy agreement does not therefore have to have already been changed accordingly. For a tidy next step it helps to keep the actual living situation, internal arrangements and agreements with the letting side apart.
First establish the existing contractual situation
Our editorial recommendation: have the actual contract and any amendments ready. Who is a party to it? Are there other agreements that might be relevant to the current situation? Separate that from the question of who has so far transferred which share or which rooms have been used. An internal payment habit and a contractual position are different pieces of information.
The Oberlandesgericht Oldenburg explains in a published decision on a specific divorce case that a joint tenancy agreement creates rights and obligations for both persons and that moving out does not by itself resolve the question of liability. [Q1] The decision is an example of the necessary legal separation of the questions. Its outcome in that individual case must not be taken as an automatic solution for every separation.
Organise the immediate everyday matters without premature legal commitments
Record which practical tasks are actually due in the next few days. These can include a planned furniture move, the secure storage of personal documents and necessary contact channels. Agreed appointments and still open proposals should be marked differently. No one should infer from a mere calendar entry that a contract has already been bindingly changed.
If communication is strained, short factual messages with a single concrete question each help. Confidential documents do not have to end up in a jointly handed-over moving folder. This article presupposes a secure conversation situation. In cases of threat or violence, a normal joint organisational meeting is not the appropriate starting point; immediate appropriate support is then needed.
Name clearly the wishes regarding the contract
Set out which solution should even be considered: continuation by one person, a joint termination or a different arrangement. Describe this as a request as long as no suitable agreement exists. An internal arrangement cannot automatically be treated as a declaration by the letting side. Which consent and form are required in the individual case should be clarified professionally.
In the case of marriage, children, other co-tenants or special contractual constellations additional questions can arise. A simple template from the internet cannot reliably cover these differences. For that reason this article contains neither a ready-made termination nor a general release declaration or deadline calculation. Have contentious points checked individually in good time.
Example: the moving date is set, the contract change is not
One person organises the move for the end of the month. Both have discussed that the other person should take over the ongoing payments in future. A corresponding contractual clarification has, however, not yet been completed. In the overview therefore move, internal payment arrangement and desired contractual solution are kept as three separate items.
The parties request a comprehensible response to the specific contractual wish and seek advice if necessary. The organisational process is not used as evidence that the person moving out has already been released from all obligations. Precisely this separation can prevent differing ideas about the same step from arising weeks later.
Record payments and documents in an orderly way
Record actual payments with period and receipt, without deriving a legal distribution from that alone. Deposit, operating costs and existing claims can also raise separate questions. A freely chosen half-share amount is not a rule resulting from this article. Keep existing agreements unchanged and clearly label new drafts as such.
For one’s own planning it is important not to set outstanding liabilities to zero just because a move has already been paid for. Check which expenses are actually settled and where a binding answer is still missing. When taking advice note the specific question so that housing organisation and legal review do not talk past each other.
The next sensible step
Create three short lists: current contractual status, planned practical steps and desired legal clarification. Bring these documents to suitable advice or a factual conversation with the responsible contractual parties. The article is intended to make the preparation clear. It does not decide who may remain, how long someone must pay or what claim exists between former partners.
