The contracting party is AD immosearch e.U., owner Aldin Dacić, Antonie-Alt-Gasse 16, 1100 Vienna, Austria, company register number FN 583188f, Commercial Court of Vienna, VAT number ATU78482278 (hereinafter “Immosearch”). Further information is provided in the imprint.

These General Terms and Conditions and Terms of Use apply to the use of the Immosearch website and platform, in particular at www.immosearch.eu, as well as to the associated functions, user areas and digital services.

They apply to visitors to the website, registered users, prospective buyers, providers, estate agents, property developers, businesses and other professional users, insofar as they use Immosearch.

These conditions apply to consumers and businesses. A consumer is anyone who uses Immosearch not in the course of a business (§ 1 KSchG). Mandatory rights of consumers take precedence over these conditions; provisions that expressly apply only to businesses are marked accordingly.

The conditions apply both to free functions and to paid services, business functions, provider and estate agent accounts, SaaS packages as well as future extensions, insofar as these are offered by Immosearch.

Supplementary terms, service descriptions or individual agreements may apply to individual functions, packages or additional services. In the event of a conflict, individually agreed provisions take precedence over these general terms.

Immosearch operates a technical platform for the presentation, search, administration and brokerage of information on real estate offers as well as for the transmission of contact enquiries.

Immosearch is not automatically a seller, landlord, estate agent, property developer, contracting party, representative or vicarious agent in relation to any real estate transaction between prospective buyers/tenants and providers.

Contracts for the purchase, lease, brokerage, viewing, reservation or other use of a property are concluded exclusively between the respective parties involved, unless expressly agreed otherwise in writing in the individual case.

Immosearch gives no guarantee that a property transaction will be concluded via the platform, that an enquiry will be answered or that a particular economic success will be achieved.

The property offers, texts, images, plans, documents, prices, floor area details, availabilities, operating costs, energy performance certificates, commission notices and other information published on Immosearch generally originate from the respective providers, estate agents, businesses, connected interfaces, external data sources or the property and media data provided by the provider.

The respective provider is responsible for the accuracy, completeness, up-to-dateness, lawfulness and admissibility of the listings.

Immosearch does not fully review content prior to publication and assumes no warranty that information is at all times complete, up to date, error-free or legally accurate.

Users are obliged to verify, or have verified, all information essential for them prior to concluding a transaction.

Immosearch may technically display, structure, sort, shorten, normalise, categorise, transform and prepare listings for display on the platform, insofar as this is necessary or expedient for operation, display, search, security, quality or technical functionality.

Certain functions may require registration or login. Users are obliged to provide accurate, complete and up-to-date information when registering and to update such information in the event of changes.

Access data must be treated confidentially and protected from access by third parties. The sharing of logins with unauthorised persons is not permitted.

Users are responsible for all actions carried out via their account insofar as they initiated them or could have prevented abusive use by reasonable security measures.

Immosearch may temporarily block, restrict or delete accounts if there are indications of abuse, false information, security risks, legal violations or breaches of these terms.

Favourites, search profiles, notifications and comparable convenience features are provided on a voluntary basis and subject to availability. Immosearch does not guarantee that notifications will always be delivered completely, free of errors, in a timely manner or on a permanent basis.

Professional users, in particular providers, estate agents, property developers, businesses and other business users, are responsible for all content published or provided via their account.

Employee accounts, sub-accounts or authorised users may be assigned to a company or provider profile. The respective company is liable, to the extent permitted by law, for the acts of its authorised users.

Providers must ensure that they are authorised to publish, edit and use the respective property listings, images, plans, documents, logos, texts, company data and other content.

Providers are themselves responsible for complying with statutory information obligations, labelling obligations, brokerage obligations, trade law requirements, consumer protection requirements and other applicable regulations.

Immosearch is not obliged to examine provider information in advance for its legal completeness or admissibility.

Immosearch may, where available, take over property and media data via connected interfaces, external property software, XML files, APIs or other import channels.

Responsibility for the data delivered, imported or synchronised remains with the respective provider.

Immosearch gives no guarantee that data imports will at all times be error-free, complete, up to date, uninterrupted or in a specific format.

Erroneous source data, technical disruptions, changes to external systems, interface changes, format deviations or incomplete transmissions may lead to incorrect, delayed or incomplete representations.

Providers are obliged to regularly review imported data and to correct errors without delay or report them to Immosearch.

Immosearch may technically normalise, convert, structure, compress, validate and prepare imported data for search, display, preview, quality assurance and platform operation.

Immosearch may, where available and depending on the package booked, offer functions for the preparation, planning, preview or publication of social media posts.

Users can thereby prepare content for platforms such as Facebook, Instagram, LinkedIn, X, Pinterest or other external platforms. The actual availability of individual platforms or functions is not guaranteed.

Users remain responsible under their own responsibility for all prepared, approved or published content. This applies in particular to texts, images, videos, hashtags, price information, property details, legal notices, labels and advertising statements.

Immosearch does not guarantee reach, leads, enquiries, sales, likes, comments, followers, visibility or any other economic success.

External platforms are subject to their own terms of use, technical rules, interfaces, API limits, verification mechanisms and restrictions. Changes, outages, blocks, delays or limitations by third-party platforms are outside the sphere of influence of Immosearch.

Failed publications, delays or restrictions caused by third-party platforms do not automatically constitute a breach of duty by Immosearch.

Contributions created in the Publisher are published by Immosearch only after confirmation by the user. In the case of the social media automation, the user sets rules, platforms and times; the automation then publishes contributions without individual approval. The user may pause or switch off the automation at any time and remains responsible for the published content.

Immosearch may, where available, offer AI-supported functions. These may, for example, generate texts, property descriptions, summaries, headlines, hashtags, image captions or suggestions for social media posts.

AI-generated content constitutes suggestions and does not replace the user’s own review.

Immosearch gives no guarantee for the factual, legal, linguistic, promotional or technical correctness of AI results. In particular, it is not guaranteed that AI texts are legally suitable for a specific property, target group, platform or publication.

Users are obliged to review AI-generated content before use, publication or disclosure and, where applicable, to adjust it. If the user employs the social media automation with AI texts, the user thereby consciously opts for publication without individual review; the user may edit or delete texts at any time afterwards and pause the automation.

Responsibility for the use and publication of AI-generated content remains with the user.

Immosearch may at any time restrict, modify, deactivate AI functions, replace them with traditional functions, or offer them only in certain packages.

For the social media tool, Immosearch offers the packages Basic, Pro and Ultimate. Basic is permanently free of charge; Pro and Ultimate are chargeable subscriptions (hereinafter “subscription”).

The scope of services of the packages follows from the package overview on the subscription page in the user account at the time of booking.

Functions may be limited depending on the package, for example with regard to the number of linked accounts, agents, posts, social media functions, AI functions, storage capacity or support.

There is an entitlement to specific future features only if these have been expressly agreed in writing.

Beta, test, preview or pilot functions may be changed, restricted or removed at any time. They may contain errors and are not necessarily part of a permanently owed scope of services.

A subscription is booked in the user account on the subscription page. Payment is made via the payment service provider Stripe (Stripe Payments Europe, Limited, Ireland). The contract is concluded upon completion of the order in the Stripe checkout.

There is a free trial period of 30 days for Pro and Ultimate. It is available only once per user account.

Trial period without means of payment: If the trial period is started on the subscription page without a means of payment, no paid subscription arises. It ends automatically after 30 days; thereafter the package that would apply without a trial period applies, usually the free Basic. No cancellation is necessary. The customer will receive a reminder by e-mail 7, 3 and 1 day before the end.

Trial period with means of payment (insofar as offered on the subscription page): To start the trial period, a means of payment must be provided. No later than 7 days before the end of the trial period, the customer will receive a reminder by e-mail. If the subscription is not cancelled by the end of the trial period, it will automatically convert into a paid subscription thereafter. Cancellation within the trial period is free of charge.

Purchase during a trial period without a means of payment: A higher package applies and incurs costs with immediate effect. A booked identical package applies with immediate effect. In the case of a lower package, the tested package remains available until the end of the trial period; thereafter the booked package begins. In both cases, the obligation to pay begins at the end of the trial period, but at the earliest 48 hours after the booking (up to two additional days free of charge).

A prerequisite for a subscription is an active connection to a supported real estate software (CRM), insofar as this is specified on the subscription page.

The monthly price displayed on the subscription page at the time of booking applies. It remains the same for the term of the subscription, unless it is changed pursuant to clause 15.

Billing is carried out monthly in advance via Stripe. The amount will be collected automatically using the stored means of payment. VAT will be calculated in accordance with statutory requirements and shown on the invoice.

Invoices and payment receipts are transmitted by e-mail and can be retrieved in the customer portal of Stripe.

Discount or promotion codes apply only under the conditions specified with the code.

A subscription runs for an indefinite period and is automatically renewed by one month at a time. There is no minimum term.

The customer may cancel at any time with effect at the end of the current billing month without having to observe a notice period. Cancellation is possible in the user account (subscription page or Stripe customer portal) or by sending a message to Immosearch (contact form or post).

All functions of the package shall remain available until the end of the paid period; the termination may be withdrawn until then. Thereafter, the free package Basic shall apply.

Periods already paid for will not be refunded on a pro-rata basis in the event of termination. The statutory right of withdrawal of consumers (Clause 17) remains unaffected.

Immosearch may terminate the subscription by giving one month’s notice to the end of a billing month. The right of both parties to terminate for good cause remains unaffected.

A switch to a higher package (upgrade) takes effect immediately. The difference for the current month will be calculated pro rata and invoiced immediately; the additional features apply as soon as payment is confirmed.

A switch to a lower package (downgrade) takes effect at the end of the current billing month, without any pro rata credit.

After a downgrade, the limits of the new package shall apply. Linked accounts, agents or scheduled posts that exceed those limits will be paused but not deleted. In the event of a later upgrade, they will be reactivated.

If a due payment cannot be collected, Stripe informs the customer by e-mail and attempts collection again. The customer can update the means of payment in the customer portal.

After the first failed payment, the functions of the package will remain available for 7 more days. If payment has not been made by then, the Basic package shall apply; scheduled posts that are no longer permitted will be paused. If the outstanding payment is settled at a later date, the package will be restored.

Statutory claims due to default of payment remain unaffected.

Immosearch may change the prices for ongoing subscriptions, in particular if the costs for hosting, AI services, payment processing or interfaces of external platforms change. Price reductions will likewise be passed on.

Immosearch will announce a price increase at least 30 days before it takes effect by e-mail. It applies at the earliest from the first billing month after expiry of this period.

The customer may cancel the subscription free of charge until the price increase takes effect; Immosearch points this out in the announcement.

In relation to consumers, a price increase shall only apply if the consumer expressly consents to it. If they do not consent, the subscription shall continue at the previous price; Immosearch may then terminate it in accordance with Clause 12.

If a subscription ends, the user account will be changed to the free Basic package. Data, connections and the post history will not be deleted; features and scheduled posts that are not permitted in Basic will be paused.

For as long as a subscription is running, the user account cannot be deleted. After the end of the subscription, the user can delete their account at any time themselves. What is deleted or anonymised in the process is set out in the privacy policy.

Consumers have a statutory right of withdrawal for contracts concluded online. This clause does not apply to businesses.

Notice regarding the trial period: A trial period without a means of payment is not a contract subject to charges and ends by itself. In the case of a trial period with a means of payment and in the event of a purchase during the trial period, no costs shall be incurred until the commencement of the payment obligation; withdrawal is generally free of charge during this time. The withdrawal period begins upon conclusion of the subscription, not only upon the commencement of the payment obligation.

Instructions on withdrawal

Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (AD immosearch e.U., Antonie-Alt-Gasse 16, 1100 Wien, Österreich, e-mail: anfrage@immosearch.eu) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form set out below for this purpose, which is, however, not mandatory.

To comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal: If you withdraw from this contract, we shall reimburse you all payments that we have received from you without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this reimbursement.

If you have requested that the services begin during the withdrawal period, you must pay us an appropriate amount corresponding to the proportion of the services already provided up to the time at which you inform us of the exercise of the right of withdrawal in respect of this contract in comparison with the total scope of the services provided for in the contract.

The use of Immosearch is only permitted within the scope of the intended functions and applicable laws.

In particular, prohibited are unlawful content, false or misleading property information, content without sufficient rights, discriminatory content, unlawful advertising, abusive contact requests, automated scraping, automated mass queries, manipulation of the platform, circumvention of technical protective measures, interference with the infrastructure, unauthorised access, as well as any use that may impair the security, availability or integrity of the platform.

Immosearch may investigate unlawful or abusive uses, block content, restrict functions, deactivate accounts and, where necessary, take further legal action.

Providers and users shall generally retain their rights to the content they provide.

However, you grant Immosearch the rights of use necessary for the operation, display, promotion, technical processing, search, preview, quality assurance, storage, conversion and provision of the platform.

These rights include in particular the right to store, display, reproduce, process technically, reduce, convert, structure, transform into preview images and use within the scope of the platform and related functions.

Insofar as social media preparations, previews or publishing functions are offered, the grant of rights also includes the technical use required for this purpose.

Providers confirm that they hold all necessary rights to the content provided and that no third-party rights are infringed by its use.

Providers shall indemnify Immosearch, to the extent permitted by law, against claims of third parties arising from unlawful, defective, insufficiently licensed or impermissibly provided content.

If users send contact enquiries via Immosearch, these enquiries may be stored, processed, handled internally and forwarded to the responsible provider, estate agent or other recipient.

There is no entitlement to a response by a provider. Immosearch does not guarantee that a property is still available or that an enquiry will lead to the conclusion of a contract.

Abusive, automated, insulting, unlawful or manifestly improper contact enquiries may be blocked, filtered or not forwarded.

Immosearch endeavours to provide the platform reliably. However, uninterrupted, constant or error-free availability is not owed, unless expressly agreed otherwise.

Maintenance, updates, security measures, technical malfunctions, hosting issues, e-mail issues, interface issues, outages of external services or other circumstances may lead to restrictions.

Immosearch may further develop, modify, improve, replace, temporarily restrict or remove functions, insofar as the legitimate interests of the users are adequately taken into account and no expressly promised principal performance is unreasonably impaired.

Immosearch is liable in accordance with the statutory provisions. Towards businesses, liability is limited, insofar as legally permissible, to intent and gross negligence.

In the case of slight negligence, Immosearch is liable only to the extent mandatorily provided by law or where essential contractual obligations are affected. Liability for personal injury remains unaffected.

Immosearch is not liable for incorrect, incomplete or non-current provider information, insofar as this originates from providers, external data sources or connected systems and Immosearch does not bear any statutory responsibility.

Immosearch is, insofar as legally permissible, not liable for loss of profit, absence of enquiries, absence of reach, failed sales, failed rentals, absence of likes, comments or other economic expectations.

Immosearch is not liable for outages, changes or restrictions of external platforms, interfaces, data sources or services, insofar as these lie outside Immosearch’s sphere of influence.

For AI-generated suggestions, Immosearch shall not be liable, to the extent permitted by law, where users use or publish these without their own review.

Mandatory consumer rights remain unaffected.

Users and third parties may report allegedly unlawful content, infringements of rights or abusive uses via the contact channels provided on the website.

A report should describe as precisely as possible which content is affected, why this is alleged to be unlawful or infringing, and how Immosearch can locate the content.

Immosearch may review reported content, temporarily block it, remove it, restrict it, or request further information.

Affected users may be informed about measures insofar as this is legally required or expedient and there are no overriding reasons to the contrary.

Immosearch reserves the right to provide a separate reporting form or a structured reporting procedure.

Information on the processing of personal data can be found in Immosearch’s privacy policy.

Personal data may in particular be processed in connection with user accounts, registration, login, contact enquiries, search profiles, favourites, notifications, provider and business accounts, social media connections, AI functions, technical logs, security measures and support enquiries.

The terms of use do not replace the privacy policy.

Immosearch may amend these terms if this is necessary due to further development of the platform, new functions, or legal or technical changes.

Immosearch will notify you of changes affecting an ongoing subscription by e-mail at least 30 days before they take effect.

In relation to businesses, the amendments shall be deemed accepted if they do not object before they take effect; Immosearch shall draw attention to this in the notification.

In relation to consumers, material amendments shall only apply with express consent. Without consent, the previous version shall continue to apply; Immosearch may then terminate the subscription in accordance with Clause 12.

Price changes are governed exclusively by clause 15.

Austrian law applies, excluding international conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG), insofar as no mandatory consumer protection provisions conflict with this.

For disputes with businesses, the court with subject-matter jurisdiction at the registered office of the operator of Immosearch shall have jurisdiction, to the extent permitted by law. Mandatory places of jurisdiction for consumers remain unaffected.

Should individual provisions of these terms of use be or become ineffective, the effectiveness of the remaining provisions shall remain unaffected.

The contractual language is German, unless expressly agreed otherwise.

Individual written agreements take precedence over these general terms and conditions.
