Your new place of work is abroad. The German flat has been terminated, some furniture has already been collected, the key will only be handed over later. When is the deregistration correct? A useful preparation first separates contract dates, the actual move-out and the question of whether a new dwelling in Germany will be taken.
The legal starting point is not a general travel duration
§ 17 Absatz 2 Bundesmeldegesetz concerns the move-out from a dwelling when no new dwelling in Germany is taken. In that case deregistration is envisaged within two weeks after the move-out. It is possible at the earliest one week before the move-out; the register of residents will be continued as of the date of the move-out. [WEGZUG]
The sentence therefore does not explain every stay abroad by means of a blanket number of holiday days or months. Someone who actually continues to use a German flat is in a different situation to someone who gives it up. In case of doubt the actual course of residence is described and clarified with the registration authority, rather than deriving an alleged obligation or exception from a general travel formula.
The timeline has several strands
Lay side by side: end of use as a dwelling, intended key handover, contractual payment periods and the actual next accommodation. The dates need not be identical. Mark any plan that can still be shifted explicitly as such.
In the fictional case Sara leaves her flat for good while agreed clearance work is still ongoing. She should not simply enter the later contractual end as her move-out date without checking. Likewise the first furniture collection is not automatically the actual move-out. For an enquiry she explains the concrete sequence including remaining use and accommodation.
The registration is its own procedure. A termination with the provider or a change of address sent to the property management is not already the carrying out of the deregistration with the registration authority. Conversely Sara does not treat the completed registration process as proof that all private contractual obligations have ended.
Prepare, carry out, check completion
Find the route and the required proofs intended for the concrete authority. Have your information ready so that the actual move-out and the new situation remain understandable. A saved draft will not be ticked off as a completed procedure.
After completion keep the issued confirmation with the associated data. If the information is not correct the correction will be clarified with the responsible office. An official document must not be altered to fit by yourself.
The abroad file remains broader than the deregistration
As an organisational recommendation, residence law at the new place, tax questions, insurances, service of documents and ongoing contracts are kept separately. Deregistration does not answer these questions for your personal case. Especially with continued use of accommodation and a return plan it is worthwhile to create a consistent description for the respective responsible offices.
This article concerns the German registration framework for the described move-out. It is not a decision on international residence or foreign registration deadlines. Its aim is a correct starting question: What is actually being given up, what remains and which registration procedure follows from exactly this residential situation?
