Reader question: What do I have to prepare for legal aid (Verfahrenshilfe) in an Austrian tenancy proceeding and which costs are not covered as a flat rate?
An Austrian tenancy dispute is to be brought before a civil court, but you cannot bear the anticipated personal litigation costs. Legal aid (Verfahrenshilfe) can help under statutory conditions. It is not a blanket protection for a guaranteed win and not a general voucher for arbitrary disputes. Therefore prepare the specific legal matter and your financial circumstances together.
Two requirements go together
According to §63 ZPO, legal aid (Verfahrenshilfe) is to be considered insofar as you cannot cover the procedural costs without impairing the necessary maintenance and the intended pursuit or defence of rights does not appear to be manifestly frivolous or hopeless. The provision describes the necessary maintenance as means for a modest standard of living for you and the family for whose maintenance you are responsible. [ATZPO63]
A low monthly payment alone therefore does not decide the approval. Arrange income, assets, liabilities and maintenance obligations so that the actual leeway becomes apparent. The court also needs a comprehensible account of the tenancy dispute.
Make the legal matter tangible
Write down what is in dispute, who is involved and what judicial assistance or defence you need. File the contract, material letters and any court mail already received with your documents. §66 requires the specific designation of the legal matter and a declaration of assets no more than four weeks old with the information described by law and reasonable evidence. [ATZPO66]
This article does not provide its own application form. Use the prescribed judicial channel and clarify the current document requirements. An old asset statement stored somewhere does not replace a current correct declaration.
Clarify the competent authority and the scope
The application must be submitted in writing or recorded in the minutes to the court of first instance pursuant to §65. Under the local conditions stated there, a recorded declaration at the district court of your residence may be possible. [ATZPO65]
The benefits may include, for example, provisional fee waivers and, under conditions, the assignment of a lawyer. §64 requires the approval order to specify which benefits are granted in whole or in part. Therefore read the actual order; not every approval automatically contains the same scope of services. [ATZPO64]
A hypothetical tenancy proceeding with outstanding external costs
A tenant wants to resist a specific claim in court. Legal aid is examined for her own costs. She also asks about the case that she loses. The official information makes clear that possible opposing party legal fees may remain despite one’s own legal aid. [BMJHILFE]
The tenant therefore regards the aid as access to the proceedings, but has the claim, prospects and remaining risk reviewed. Neither the application nor a later approval confirms that her position is correct.
Remain attentive after the decision
§71 provides under its conditions for a later supplementary payment if the party is then able to do so without impairing the necessary maintenance. After the expiry of three years following the conclusion of the proceedings, this obligation can no longer be imposed. [ATZPO71]
Therefore keep the decision and financial evidence organised. If procedural deadlines are running, it must be clarified separately which action remains necessary when; the article does not promise an automatic extension of any deadline through every inquiry. It concerns Austrian civil procedure. Proceedings before a conciliation board, non-contentious matters and other judicial routes must be classified according to their own rules.
