You want to sell a German property and need support with hearing, seeing, speaking or writing. For the preparation it is crucial to coordinate this concretely with the notary's office in good time. An accompanying person chosen by you does not automatically resolve every procedural question. The article does not describe a medical impairment and does not decide legal capacity.
Describe the practical needs yourself
Our editorial recommendation: State which communication works for you and which situation at the appointment would be difficult. For example, a clearly readable preparatory version can help, while a telephone call may be unsuitable. Ask for the procedure appropriate to the specific notarisation.
There is no need for a general private medical history in the sales distribution. The relevant support needed will be clarified specifically with the responsible office. Practical assistance should support you in your own declaration and should not assume your position without your consent.
Go through the special rules with the notary's office
§ 22 BeurkG deals with parties who cannot hear, speak or see sufficiently. It mentions the involvement of a witness or a second notary with a specific possibility of waiver as well as, at the request of a hearing- or speech-impaired party, a sign language interpreter. [BEURKG-22]
§ 25 BeurkG regulates the case where a party cannot write their name, and provides for certain participation in reading aloud and approval. [BEURKG-25] Which requirements interact in your concrete situation and how they are implemented is clarified by the notary's office. The article does not provide a general private substitute signature.
An invented appointment with a false assumption
A seller has difficulty reading small print and can only follow longer conversations with support. The buyer's side assumes that their daughter can simply summarise everything at the appointment. The seller, however, wants to understand and decide for herself.
She therefore agrees the actual needs with the notary's office in advance. The role of a desired accompanying person and the required procedural support are clarified separately. A friendly familial offer is not treated as proof that all legal requirements have already been fulfilled.
Prepare documents so that follow-up questions are possible
Please request in good time the presentation of the current draft version that is suitable for your engagement. Mark questions with a clear reference point and indicate which response method you need. The article does not promise a specific technical format in every notary's office, but recommends a concrete early coordination.
Have vague terms and factual deviations explained. An enlarged presentation does not answer an unknown legal consequence. Conversely, a technical explanation must not fail because the chosen communication channel is practically unusable for you.
Know the confirmed procedure for the appointment
Record who will participate, what support is planned and which documents you will receive beforehand. If your needs change, inform the responsible office. A short-term replacement by any additional person is not recommended here as a universal solution.
With this preparation your own participation remains central. The sale does not have to be improvised out of an unspoken difficulty nor taken over by other people without a clarified role. The legal requirements and the practically appropriate communication are brought together in good time.
