Rent arrears are not only a reason to seek advice when an eviction date has already been set. For an appropriate first enquiry it is important, however, whether only payments are missing so far, a court has already written, or a concrete date exists. These differences help an advisory centre to classify the actual situation. A general message “I have housing problems” can obscure urgent information.
This article applies to Austria, specifically Vienna. It explains the services of FAWOS and WOHNSCHIRM MIETE and supplements our editorial preparation guide. It does not decide any entitlement to funding and does not calculate any court deadline.
A short statement of the facts precedes a long backstory
Note the type of dwelling affected, the known outstanding months and the most recent letters. Indicate which sum you can verify yourself and which still needs to be checked. Unclear dunning charges or payments booked differently are not silently equated with an unverified total sum.
For the first contact it is particularly important what has changed most recently. A received eviction claim is different news to a reminder from the property management. Do not send a court letter only under the filename “Other” — name it explicitly in the enquiry. That does not replace an examination of its legal significance.
Does FAWOS fit your housing situation?
The specialist service names private and cooperative flats as well as municipally owned flats under external management in Vienna as its target groups. Its advice is free and voluntary. FAWOS does not itself allocate flats and does not have its own funds for cash assistance. [FAWOS]
Thus advice, assistance with the application and decisions about cash benefits are different things. An invitation or a friendly response does not mean that a payment has already been approved. If the type of dwelling does not match the stated offer, the responsible alternative advisory route must be clarified, instead of simply assuming jurisdiction.
Differ between no proceedings and with a court letter
For rent arrears without court proceedings FAWOS currently describes an online information service. For further processing of personal enquiries without eviction proceedings the provider FAQ names a current tenant account statement of the last three rent payments. In the case of court proceedings or an eviction date prompt contact is envisaged. [FAWOS]
This provider requirement is not a general statutory deadline and is not an instruction to leave an urgent letter lying around at first. Describe your actual situation and ask for the appropriate current procedure. If you do not yet have the required document, state that exact gap when clarifying the contact route.
WOHNSCHIRM MIETE is a support route to be examined
According to its information the programme is aimed at people with their main residence in Austria who cannot pay their rent arrears themselves. The conditions are clarified in the personal advisory interview. Advice and application are free of charge. [WOHNSCHIRM]
An important limit: the programme names as examples of debts not to be assumed those debts that were only taken out in order to pay the rent. [WOHNSCHIRM] Before taking out a new loan or a family cash solution of your own, the changed type of debt should therefore also be addressed in the advice. The article does not recommend any specific loan nor a blanket cessation of payments.
The hypothetical case: while waiting a new letter arrives
Lara has requested advice and is waiting for a response. In the meantime she receives a court letter. She does not assume that the earlier enquiry already covers this new development. Instead of sending a second long life story to another place, she reports the concrete additional event with the existing contact reference.
WOHNSCHIRM explicitly asks that a termination, eviction claim or an eviction date received during the waiting period be communicated to the responsible advisory centre. [WOHNSCHIRM] Lara also has clarified which deadline and action are important independently of a funding decision. An applied-for sum of money is not yet a confirmed receipt.
Keep the current month visible alongside the old arrears
Our recommendation is a small overview with three separate lines: known older arrears, the current ongoing payment and an applied-for or actually approved support. This way an expected help is not planned twice as available money.
The conversation includes the documents actually required and open questions. Not every private document is distributed prophylactically to several places. The aim is an understandable status on which the advice can continue to work. Even if the situation is stressful, it does not have to be resolved with a single unverified promise: the appropriate next enquiry, a visible question of deadlines and a clear payment status are already concrete preparatory steps.
