Reader question: How do I verify my right to reimbursement if I paid an entire joint rental debt from my own money?
The joint monthly rent of your Austrian flatshare has been paid because you transferred the entire debt from your own funds. The other participants have not fully settled their internal shares. You now need a comprehensible claim. Do not start with an arbitrary room quota or the assumption that the landlord will sort out the private settlement for you.
Starting point: Is there really a joint (solidary) debt?
§891 ABGB describes the obligation of several persons to an undivided obligation and the possible claim of the whole in the external relationship. Whether your contract actually creates such a joint obligation and who belongs to it must first be determined. Not every person who lives in the flat is automatically the same co-debtor. [ABGB891]
This article presumes a correspondingly established joint rental debt. With separate room contracts, subletting or a mere voluntary household contribution the classification can look different. Therefore provide the complete contract and not just your private cost list.
Prove your full payment
§896 ABGB gives a co-debtor who has borne the whole debt out of their own means the right of recourse even without an assignment of rights having taken place. The provision focuses on the special relationship of the parties; if no other relationship exists it names equal shares. [ABGB896]
Therefore secure amount, period, purpose of payment and the actual outflow of your transfer. Which joint debt was paid in full? A merely instructed payment order or a private estimate of the rent account is not sufficient. Different months are considered separately.
Check the internal basis instead of mere habit
What comprehensible agreement did you make about the internal shares? Is there a special distribution, a temporal change or already a disputed point? The statutory default rule of equal shares must not be applied without checking in place of an actually existing different internal relationship. [ABGB896]
Place the relevant agreement and later changes next to your payment. A self-created new allocation key is not yet a confirmed prior agreement. If the extent is disputed, that very difference belongs in the legal examination.
Calculated fictitious settlement
Assume a joint monthly debt amounts to 900 euros. For the sake of example an effective internal distribution of 450 euros for A, 300 euros for B and 150 euros for C is already clarified. A pays the entire 900 euros from their own money. Afterwards B first repays 100 euros, C nothing yet.
From the assumed distribution there remain mathematically 200 euros from B and 150 euros from C outstanding. Together that is 350 euros. The 100 euros already received must neither be forgotten nor demanded again. The figures are freely chosen and do not confirm a real agreement or actual claim amount.
Define the claim clearly
Name the joint debt, your own payment, the internal basis and the reimbursement already received. Private furniture purchases and other household disputes are not to be added into the same balance without a comprehensible basis. That way the other person can recognise which specific transaction is being demanded for payment.
§896 also contains rules for certain failing shares; no arbitrary redistribution from an unclear dispute should be derived from it. [ABGB896] In case of disagreement or missing reimbursement have claim, deadlines and enforcement route examined separately. The result is a substantiated internal claim, while the debt already settled vis‑à‑vis the landlord remains recognisable as its own matter.
