After a fire or water damage you may immediately need a safe place to sleep. At the same time you will receive messages about repairs and questions about the next rent payment. These processes are connected but have different prerequisites. Arranging alternative accommodation does not automatically terminate the contract and does not by itself clarify who pays which bill.
Safety and accessibility first
In an acute incident follow the instructions of the responsible emergency services. Do not enter a cordoned-off or unsafe area for photos or documents. Our editorial recommendation for subsequent organisation: note where you can be reached and which accommodation you can actually use initially. If you cannot find your own solution, contact the locally responsible office for acute housing questions, without inferring any specific cost commitment from that alone.
Inform the letting party about the known damage and how to contact you. § 536c BGB regulates the immediate notification of defects that arise during the tenancy. [BGB] If an emergency service has already attended, its file reference does not necessarily replace your own comprehensible communication with the contractual partner.
Obtain three separate answers
The first answer concerns current usability: which areas may be used, what must be professionally examined and who can provide reliable information? A scheduled tradesperson appointment is not a confirmed re-release. Leave unclear assessments as such.
The second answer concerns money. § 536 BGB distinguishes between aufgehobene and reduced fitness for use (Gebrauchstauglichkeit); § 536a contains its own prerequisites for damages. [BGB] Therefore the necessity of a hotel does not automatically create a claim for reimbursement in any desired amount. Insurance benefits also depend on the specific policy and the circumstances. Explicitly ask the respective bodies about responsibility and the confirmed scope.
The third answer concerns the continuation of the tenancy. § 543 BGB requires an important reason and further prerequisites for an immediate termination, including depending on the situation a period to remedy. [BGB543] A provisional move-out does not automatically make this question disappear.
Keep expenses and communications with references
Collect invoices, actual overnight periods and received responses. Distinguish between your own payments, approved reimbursements and merely submitted enquiries. Do not adopt an assumed insurance payment as secured available money. With unclear or disputed claims timely individual advice is advisable before making a consequential declaration or stopping payments.
Example: Restoration announced, date open
After a burst pipe a tenant temporarily moves in with relatives. The management announces an inspection of the affected rooms. He notes the accommodation, known limitations and the contact person, but does not yet claim a fixed return date. A later accommodation invoice and the rent question he submits separately for review. His provisional housing is not treated as an implied contract termination as a result.
Establish a reliable position after the first week
Request a concrete response to the still open questions and update your planning based on actually confirmed information. This article does not replace a hazard assessment and does not calculate a reduction quota. It helps you not to base decisions in a stressful situation solely on provisional accommodation or an unconfirmed repair announcement.
