Reader question: Is a service-charge (Betriebskosten) supplementary demand communicated late still enforceable?
The service-charge statement for a long-past year suddenly lies in the letterbox and requests money. The printed invoice date is not a conclusive proof of timely notification. Check the precise sequence of dates and the balance claimed before you pay or formulate a blanket refusal.
Read the statutory rule with its exception
For agreed advance payments for service charges, § 556 Absatz 3 BGB requires an annual statement. This must be communicated no later than the end of the twelfth month after the end of the accounting period. After the deadline has passed, a supplementary claim is excluded, unless the landlord is not responsible for the late assertion. [BGB556]
The exception is part of the rule. A merely late invoice is therefore not in every conceivable case the same final decision. Conversely, the general assertion “The office had a lot to do” is not a legally exculpatory statement confirmed by you. The actual reason for the impediment and its connection with the delay must be examined.
Record the sequence of dates using documents
Our editorial recommendation: Note the start and end of the accounting period, the date on the letter and the actual known receipt. Keep the envelope, the message or other transmission evidence. If a reliable recollection is missing, mark the date as unresolved.
Example: For a normal accounting period from 1 January to 31 December 2024, the regular expiry of the twelfth subsequent month is the end of December 2025. A letter dated December 2025 that was only communicated in 2026 must therefore be examined for the concrete sequence of dates and a possible exception. The example does not decide any disputed receipt or any special constellation.
Distinguish between supplementary claim and credit
The statutory exclusion rule names the landlord’s supplementary claim. [BGB556] Therefore do not treat a late statement showing a credit as if the landlord may, merely because of their own delay, keep any credit shown in it. Its actual amount and further questions of entitlement may also need to be examined.
Also read whether it is an initial statement, a correction or merely a reminder of an amount already communicated. A later reminder does not prove that the original statement was late. Conversely, a timely dispatched but incomplete letter does not automatically replace any required proper statement; have this question assessed concretely.
A hypothetical notice of exception
Omid receives a supplementary claim late. The management relies on a subsequently received third-party notice. Omid asks for the relevant point in time and why the delay is said not to be attributable to them. He has these details checked together with the statement.
The reference to a late third-party document does not alone decide the outcome. The concrete exceptional situation must fit the actual sequence of events. The example promises neither an automatic obligation to pay nor an automatic exemption.
Formulate your own objections in good time
§ 556 Absatz 3 also specifies a separate deadline for the tenant’s objections from receipt of the statement and also an exception for that. [BGB556] Do not confuse this with the earlier accounting deadline. An orderly query states the period, the alleged receipt, the amount demanded and the concrete deadline problem.
If there is an urgent payment deadline or a dispute about receipt and the exception, seek advice promptly. This article does not recommend a blanket change to ongoing rent payments. Its aim is a comprehensible decision on the specifically late-claimed demand.
