Reader question: Which changes to the agreed usage fee are conceivable during the academic year, and which documents do I need for examination?
The Austrian student hall of residence announces a higher monthly amount in the middle of the current year. The letter states both "increased costs" and a new additional service. Before you treat both as a single increase, separate the reason. For residential places within the scope of the Studentenheimgesetz, §13 contains its own fee rule. [StuHG1][StuHG13]
A change needs a specific subject
Place the usage contract, the associated hall statute and the complete amendment notice side by side. Which previous services are included in the agreed fee? Which item is to be newly added? From which period is more demanded?
§13 paragraph 1 requires information on the services included in the usage fee. If further chargeable services are offered, they must be expressly communicated in a suitable form with a price indication. [StuHG13] Our practical recommendation: If a mixed letter is received, ask for a separate presentation of existing service, requested increase and separate offer. That does not yet confirm that a particular additional service has been ordered or is owed.
Distinguish current academic year and next contract period
According to §13 paragraph 3, the fee valid for the respective academic year must be determined in the usage contract. An increase during this period may only be agreed to compensate for interim increases in tariffs, taxes and fees. For the subsequent contract period, an appropriately determined fee in accordance with legal principles may be provided. [StuHG13]
Thus "more expensive next year" is a different examination than "more from next month". Mark the actually affected dates. The academic year, the hall year set out in the hall statute and your specific contract period should not be equated merely because of similarly sounding names.
Hypothetical case with two different questions
A resident receives in February the request to pay 35 euros more from March. The reasons given are generally new furnishings and higher fees. At the same time a separate laundry service is offered. All numbers and events are invented.
She first asks which part of the 35 euros is based on which interim tariff, tax or fee increase and which agreement is used for this. The new furnishing is not to be tacitly assigned to the same legal category. For the laundry service she asks separately about scope of service, price and basis for any participation. A single total amount does not answer these questions.
Use the proper right of inspection for non-profit halls
For non-profit student halls, §13 paragraph 2 links the determination after consultation with the hall representation to cost coverage and the consideration of certain subsidies or earmarked grants. Earmarked reserves are also provided for by law. [StuHG13] A reserves item alone therefore proves neither an impermissible claim nor a freely available profit.
§8 grants an appointed member of the hall representation a special, at least annual right of inspection into the relevant calculation documents of non-profit halls, if necessary with authorised expert support. Confidentiality obligations must be observed. [StuHG8] That does not amount to a blanket mandate to post all internal documents publicly in a residents' chat.
Demand an answer you can examine
Narrow down the open points: affected period, previous scope of services, new items, alleged cost cause and contractual basis. Record the answer with the original letter. Unconfirmed statements are not entered as an already examined entitlement.
If a concrete amount remains disputed, have its basis and the appropriate further course examined promptly. The article does not confirm an autonomous complete stop of payments. It helps to break a blanket cost justification into individual decidable questions before the new amount is unexaminedly set up as a standing order.
