Reader question: Can I still apply for or have an appropriate extension of the eviction period granted after an enforceable judicial eviction settlement?
In the court settlement you committed to vacate the German flat on a specific day. Later it becomes foreseeable that the planned handover will not succeed in time. You want to consider an additional eviction period. For this § 794a ZPO contains its own rule which relates to a settlement from which enforcement can be carried out. [ZPO794a]
The question must be distinguished from an attack on the settlement and from a voluntary new agreement with the other party. The lack of a replacement dwelling does not automatically change the fixed date.
Provide the complete settlement
Secure the settlement, confirmed concluded status, agreed eviction day and any periods already granted. Are there further conditions or subsequent court decisions? A mere draft or a private note of a conversation will not be treated as the same enforceable title.
Also note which actual circumstance is making the handover difficult and since when it has been known. The new information belongs with its evidence to the consultation. A provisional promise of accommodation will not be presented as already secured housing, but a cancelled appointment should not be mentioned only orally in passing either.
Prepare the application before the special time limit
§ 794a paragraph 1 names the local court at the place of the dwelling and an application at the latest two weeks before the eviction day relevant under the settlement. The court decides by order and hears the creditor side beforehand. [ZPO794a]
Therefore have the concrete latest application deadline calculated immediately and clarify the effective method of filing. A request for help in finding accommodation and an enquiry to the landlord are not already the court application. If the time limit is already problematic, this must be included in the individual assessment without delay; the article does not promise any retrospective cure.
Justify the required time in a traceable way
The rule allows a period appropriate to the circumstances, not an automatically fixed additional period. [ZPO794a] Describe therefore the documented housing and search situation and the period you specifically wish to apply for. What steps have been taken? What confirmed alternative exists and what condition is still open there?
An illustrative case: A tenant party received a promise of a new flat after the settlement. The actual takeover date is demonstrably postponed. They submit the promise, the notice of the postponement and their own transition plan. The application is prepared in time; they record it as applied for until the decision and not as granted. The example does not confirm any particular outcome.
Independently check the upper limit and further extension
§ 794a paragraph 2 allows a later extension or shortening on application and refers to the relevant requirements. Paragraph 3 limits the period in total to one year from conclusion of the settlement; if a later eviction day is agreed, it is calculated from that day. [ZPO794a]
An already granted period must therefore be disclosed with its dates. The maximum limit is not the general case and not an additional entitlement to a full year after every further decision. Even for a desired extension the concrete timely filing of the application must be checked.
Do not overlook special types of contract
Paragraph 5 excludes certain residential tenancies under § 549 paragraph 2 number 3 BGB and cases of § 575 BGB. For the fixed-term tenancy referred to there following extraordinary termination a period is provided at most until the contractually specified end. [ZPO794a][BGB549][BGB575]
Therefore submit the tenancy agreement and do not transfer an example rule to an unchecked special form of housing. When deciding on the application the envisaged appeal route must also be classified separately. [ZPO794a]
Until a change is actually clarified, the settlement and the existing procedural status remain decisive. Practical support and legal handling go together: one path organises housing, the other a possible additional court period.
