Reader question: What does a judicial security order during an eviction and payment claim mean and which deadlines must I clarify separately?
In your German tenancy proceedings a new judicial decision arrives: you must provide security and prove it within a specified deadline. This can be a security order pursuant to § 283a ZPO. It is not discharged by a contractual deposit already paid on moving in. The specific judicial instruction must now be dealt with independently.
Linking the order to the ongoing proceedings
§ 283a concerns an eviction claim connected with a payment claim arising from the same legal relationship. At the request of a party, securities for monetary claims that became due after the commencement of proceedings may be considered. A high likelihood of success for these claims is required and an order justified by a balancing of interests to avert particular disadvantages to the claimant. Disputed increase amounts are not covered by the provision. [ZPO283a]
Therefore compile the order, service documents, the claim and the current payment status together. Allocate the ordered amount to the named months and claims. Whether the statutory requirements are actually met should be examined professionally and immediately. An unexpectedly large sum should neither be passively accepted nor simply ignored.
Read three tasks out of the order
What security is required and in what amount? By when must it be proven? Which submission or proof method is provided? § 283a paragraph 2 leaves the proof deadline to the court's determination. [ZPO283a]
Note this task separately from deadlines already running for responding to the claim or for a later hearing date. A message to the landlord does not yet prove that the court-required proof has been received there. Also have the type and proper provision of the security clarified concretely; the article does not recommend any arbitrary private payment method.
Appeals and the proof deadline are not the same clock
§ 283a provides for an immediate appeal against the order. § 569 generally names a two-week emergency period and governs filing and form. [ZPO283a][ZPO569] The individual calculation depends on service and the specific procedural status and is not determined here from a mere order date.
§ 570 limits the suspensive effect of an appeal and opens up judicial possibilities for suspension. [ZPO570] Therefore expressly ask how a lodged remedy affects the current order and whether an additional application is required. Mere hope that lodging an appeal suspends every obligation is not a reliable way to handle deadlines.
Non-compliance can trigger another housing issue
§ 940a paragraph 3 allows, in an eviction claim due to payment default under the conditions set out there, an eviction order if the security order is not complied with. Paragraph 4 requires a prior hearing. [ZPO940a] The order should therefore be examined immediately even if you still consider the original termination to be unfounded.
An economic difficulty should be reported truthfully and with available evidence for consultation. The article promises neither an automatic exemption nor a specific assistance. What matters is that the actual need for action becomes visible in good time.
Fictitious case: An old list of deadlines is not enough
One tenancy party has already prepared the defence to the claim. Afterwards a security order for certain subsequently due amounts arrives. It supplements the previous list with the proof deadline and simultaneously has the possibility of appeal examined. Payment receipts are allocated to the affected months; an asserted increase portion is marked separately.
Security does not yet mean final enforcement
§ 283a separately governs when a subsequent conclusion permits satisfaction from the security and when damages for non-existent secured claims are to be considered. [ZPO283a] The provisional order therefore does not replace the final decision on any claim. Keep performance and cost evidence for this further course and continue to handle the main proceedings fully.
