Reader question: When must my consent be considered separately for an improvement planned by the Bauvereinigung within my flat?
The Bauvereinigung offers to change the fixtures of your Austrian flat. A letter combines necessary works with an additional comfort proposal and demands a prompt signature. Before you consent or reject everything, the individual services should be classified. The WGG distinguishes maintenance (Erhaltung) and beneficial improvement (nützliche Verbesserung) as separate areas of responsibility.
What already exists, what is to be added?
Describe the fixtures rented with the flat to date and their agreed condition using the contract, inventory and existing documents. Which parts no longer work? Which change would, beyond that, create a new fixture or function?
§14a WGG covers, to the extent described, among other things the maintenance of flats and fixtures rented with them in the agreed condition; the provision also names exceptions. Therefore not every new execution is automatically a voluntary improvement and not every desired renewal is necessarily maintenance. The concrete technical and legal classification must fit the actual condition. [WGG14a]
Consider the consent for the interior separately
§14b paragraph 3 requires the consent of the affected tenant or other user party for beneficial improvements to the interior of a flat. The consent of other residents to a building measure is therefore not automatically your consent to a specific interior improvement. [WGG14b]
Ask for a clearly specified scope of work. Which existing part will be maintained or replaced? Which further-reaching improvement is being offered? A blanket project name does not yet explain this difference. The review also does not fall away because the same company wishes to carry out both parts together.
Read a signature for its actual scope
Is it only about confirming an appointment, consenting to the structural change, or also about certain cost and contractual conditions? Compare the declaration with its attachments. Our editorial recommendation: Have every additional obligation explained separately before it is confirmed in an apparently purely organisational form.
This article does not assess a concrete fee agreement and does not provide its own form. Consent to execution and the review of requested payments must correspond to the actual offer. The word improvement does not imply either blanket cost-freedom or an arbitrary permissible extra charge.
A hypothetical mixed offer
In a flat a defective fixture rented with the property is to be made usable again. The same offer contains an additional comfort version that the tenant has not had to date. They request a separate description of the existing maintenance need and of the proposal beyond that.
Subsequently they can review, with advice, what is actually owed and for which items additional consent is required. The rejection of a particular additional solution will not be recklessly presented as rejection of all necessary works. Conversely, they will not automatically treat every modern-looking renewal as merely a voluntary gift.
Record the agreed standard for the execution
After clarification, the scope of work, remaining open points, access and restoration should be documented in a traceable manner. If the proposal is later changed, it must again be clear which version you understood and, if applicable, accepted.
This guide presupposes the WGG framework. It does not provide instructions for unilaterally preventing necessary works. Its outcome is a conscious, delineated decision about a concretely offered improvement in your own interior, while an existing maintenance need continues to be handled as a separate matter.
