Nina would like to buy a flat in Austria. After several conversations she receives loan documents and is asked to sign, preferably that same afternoon. At the same time the seller’s side expects a decision. Nina thinks: “If the bank is bound for seven days, I can still pull back later this week.” That exact conclusion does not hold.
The invented case concerns a consumer credit within the scope of the Austrian Hypothekar- und Immobilienkreditgesetz. The editorial recommendations help with the decision; for a contract already declared or a withdrawal already made an immediate concrete review is important.
Clarify which document you have before signing
An indicative calculation, a binding offer and your own declaration of acceptance have different functions. § 12 HIKrG prescribes, for a binding offer among other things, a durable medium, a draft contract and, where applicable, an ESIS information sheet. [ANGEBOT]
Nina therefore gathers together the documents she actually received. She asks which document binds the bank, which conditions are still open and which version she herself would accept. A verbally discussed change should not remain only in memory while other details appear in the signing document.
This is not an invitation to ignore an existing deadline. The household needs a reliable starting point: what can still be examined, by when is a declaration expected and which action would already trigger a binding effect?
The seven days protect a decision from being accepted
Under § 12 the offer must remain binding for at least seven days. However, the consumer may accept it earlier. For certain interest rates or costs determined by the underlying financing instruments the provision contains a peculiarity; the binding is therefore not described as a guarantee of every amount under all circumstances. [ANGEBOT]
Our recommendation: use the available time for the outstanding decisive questions, rather than planning it as a belated cancellation option. Nina, for example, still needs a declaration regarding the disbursement condition. The question belongs before her acceptance if it is material for the project.
The seller’s expectation is a different negotiation. Loan offer and property commitment do not become a single transaction with automatically matching deadlines. Nina has the intended declarations examined together for their actual content. The article does not assert a financing condition or a withdrawal from the purchase as a blanket matter.
The right of withdrawal is narrower than a general trial subscription
§ 13 HIKrG applies if the contractual declaration is made within two working days after receipt of the ESIS information sheet or is given without receipt of it. Withdrawal is then possible within two working days from the declaration; Saturday does not count as a working day. The period does not start before receipt of the information sheet together with the instruction and the right expires at the latest one month after conclusion of the contract. [RUECKTRITT]
These conditions are not a general seven‑day or fourteen‑day free exit period. Nina notes receipt and version of the ESIS as well as the time and content of her declaration. In an already ongoing case she does not postpone the review until the next available consultation appointment in several weeks.
A declared withdrawal also needs a plan for reversal
To preserve the deadline § 13 names paper or an accessible durable medium and timely dispatch. After withdrawal any amount already disbursed and agreed interest on the loan must be repaid without delay, at the latest within 30 calendar days after dispatch; certain non-recoverable payments to public authorities remain compensable. [RUECKTRITT]
In the fictitious case no money has yet been disbursed. Were that different, Nina would not merely send a message and consider the financing dealt with. She would have to clarify the actual payment status and the unwind procedure. It would likewise have to be examined which other contracts or obligations remain in force; the property purchase is not treated as cancelled without its own legal basis.
Make the decision consciously
Before acceptance Nina should be able to carry the specific project with the final financing and understand any material outstanding conditions. If a decisive question remains unresolved, that is a genuine reason for decision and not merely a paperwork defect.
The sensible sequence therefore is not “sign quickly and correct everything later”. A binding offer buys time before acceptance. A special right of withdrawal helps under its statutory conditions, but does not replace a well‑considered conclusion nor the review of the associated property decision.
