There is an older approved building plan for the offered plot. It may be of interest for the purchase decision, but it does not alone answer whether you can start or continue exactly this project today. Before entering into any commitment you need the context of the decision (Bescheid), the relevant timeline and the execution actually intended. The following preparation concerns Lower Austria (Niederösterreich) and does not replace an individual case review by the authorities.
Don’t just request the most attractive plan
Ask for the related documents: the decision (Bescheid), the associated approved plans and any later decisions or amendments that exist. A visualisation is not automatically the version approved by decision. Explicitly note any missing documents instead of replacing them with an oral summary.
Also collect verifiable information on the previous course of construction. Was work started according to the documents, which works are documented, and how was the status handled with the authority? A visible foundation or an old invoice does not decide these questions without technical classification.
The current framework contains different deadlines
§ 24 NÖ Bauordnung 2014 states in its current version, among other things, a commencement within two years of the decision becoming final and a completion within five years of commencement. The provision contains special rules and possibilities for extension. [FRIST] From this one cannot, for an older individual case, calculate a reliable applicability solely from the date on a cover sheet.
Have the concrete legal status, the events that are actually decisive and any existing decisions checked by the competent authority or suitable specialists. This article does not confirm either an extension or the expiry of your specific approval. A merely planned later request is also not yet a fulfilled prerequisite.
Your building wish must match the examined subject
Place, alongside the approved version, a description of what you actually intend to carry out. Is it the same project or are you planning different rooms, a different use or an altered building form? Have it explained what consequences the differences have for further planning and any required procedure.
The question of temporal applicability and the question of changes remain separate. An approval still usable for a particular version is not confirmation of arbitrary later wishes. Likewise, a suitable new idea says nothing about the status of the older decision.
Example: The plan almost fits, but not the intended household
An interested party sees an earlier approved residential building in the sales dossier. He wants to adopt the floor plan, but with an additional unit used differently. At the same time the previous course of execution has not yet been fully documented.
He first has both questions clarified: what is the status of the existing approval, and how should the deviating use be assessed? In his financial and scheduling planning he treats the project as open until an appropriate answer is obtained. An appealing plan thus replaces neither the status check nor the new use assessment.
Record a reliable working status
At the end of the preliminary check it should be clear which version was examined, which information is available about it and which next prerequisites remain open. Note the date, subject and competent authority. Pass this limited description on to other parties involved instead of using “everything already approved” as a shortcut.
If the existing approval does not provide a usable basis, a new planning may be a separate option. Whether it is permissible, financeable and timely appropriate will be examined separately. Buying a plot does not turn an unresolved older project into a confirmed immediate start of construction.
