Even before the next rent payment is due it becomes clear that money will be missing. Perhaps income will arrive later, perhaps the shortfall is longer-term. The helpful first step is to make this difference visible and to seek appropriate support in good time. Waiting until an assumed permissible number of months outstanding is reached would not be a viable housing plan.
This article applies to residential tenancy in Germany. It is an editorial preparatory aid and does not replace an individual examination of claims, terminations or entitlement to benefits. Court letters already received require prompt appropriate clarification, regardless of whether advice or assistance has been sought.
Distinguish a temporary delay from a lasting shortfall
Write down the amount actually due, what will be available in time and what additional receipt is only expected. An unconfirmed promise of money does not count as a secure payment receipt in the calculation. If older amounts are outstanding, they are reconciled with the same rent account.
In the hypothetical case the payment under consideration is 900 Euro, 600 Euro are available. The calculated gap is 300 Euro. That does not mean that a partial payment removes all legal risks or that the landlord has already agreed to a later payment. The calculation initially helps to prepare a concrete rather than merely general enquiry.
If the same shortfall is expected in the following month, further household and support needs must be taken into account. A single polite request for an extension would then not yet be a long-term solution.
Termination thresholds are not a promised line of credit
§ 543 paragraph 2 number 3 BGB names certain cases of substantial rent arrears as an important reason for extraordinary termination. For this rent arrears no warning is generally required beforehand according to paragraph 3. [RISIKO]
The provision should therefore not be understood as permission to do nothing until just before a self-calculated limit. Amounts, periods, payments and individual contractual or procedural questions need concrete classification. This article does not calculate a personal termination threshold.
§ 569 contains special rules, among other things on possible subsequent satisfaction with deadlines and exclusions. [SONDERREGEL] That does not become a general assurance that a later payment will resolve any termination and every other procedural point. If letters are already in existence, they are fully examined rather than being treated only according to the most favourable line of an internet description.
Prepare a factual response
Our recommendation is a short message with the month, the actual payment status and a realistic next step for clarification. A sample formulation reads: "For the month in question there is, according to my overview, a shortfall of 300 Euro. A further payment is not yet confirmed. I am seeking advice on this and request reconciliation of the current rent account as well as clarification of a possible agreement."
This sample is not a legally reviewed instalment agreement. It deliberately contains no firm promise of payment for a time the person cannot bear. Whether certain claims should be accepted or disputed will be professionally clarified in case of uncertainty.
An actual response is then retained. A stated wish is not yet consent to a change. Those involved should also be able to see which arrangement was actually made and which question was only asked.
Request concrete help to secure the accommodation
Those who receive the relevant benefits under SGB II should not confuse a possible assumption of debt with the normal ongoing housing payment. § 22 paragraph 8 provides under conditions for an assumption to secure accommodation or for comparable emergencies, takes into account priority assets and generally provides monetary benefits as a loan. [HILFE]
Ask the competent authority about the application appropriate for your case and the documents required. The article does not claim an automatic grant and does not transfer this provision to all other benefit systems. If responsibility is lacking or unclear, suitable local social or debt counselling can help with the appropriate next steps.
Keep the status up to the actual solution
An enquiry, a submitted application and an approved or paid support are different stages. New reminders, terminations or court post are reported to the competent counselling service. Have concrete deadline questions clarified separately; a pending application is not a self-confirmed procedural pause.
Keep old arrears, ongoing rent and any actually agreed additional payments recorded separately. That way the next decision can be based on the real course of events. The aim is neither a sugar-coated response nor the longest possible waiting time, but an early recognisable and workable path to securing the dwelling.
