Reader question: How do I prepare an application for Beratungshilfe for my rental dispute that has not yet been brought before a court?
A disputed rental claim in Germany must be legally assessed. Your means may not suffice for an ordinary instruction, and no court proceedings are pending yet. Beratungshilfe can now be the appropriate point of review. It concerns rights outside court proceedings according to § 1 BerHG; an already pending process requires a different classification. [BerHG1]
Name the matter concretely
Describe the dispute, the other party and the desired advisory outcome in a few sentences. Submit the tenancy agreement, the specific letter, known deadlines and any responses so far. A blanket request for assistance “with all housing matters” does not describe the individual case sufficiently for targeted handling.
State whether Beratungshilfe has already been granted or refused for the same matter and whether court proceedings are pending or have been pending. § 4 BerHG requires the corresponding information. [BerHG4] Different letters can concern the same matter; a new envelope colour does not make it an independent case.
Check prerequisites and the local route together
Beratungshilfe not only requires limited means. Another reasonable form of assistance and the statutory test for frivolousness also play a role. [BerHG1] Therefore name existing possibilities such as relevant existing insurance or advice, instead of dismissing their importance without checking.
Under § 4 BerHG, the district court at the general place of jurisdiction of the person seeking legal advice generally decides. [BerHG4] Regional peculiarities remain to be observed: § 12 BerHG specifically mentions public legal advice in Bremen and Hamburg as well as an option to choose in Berlin, each subject to the reservation of state law there. [BerHG12] Have the actual local access confirmed.
Prepare financial evidence completely
§ 4 BerHG requires information and evidence about personal and economic circumstances, including income, assets and liabilities. [BerHG4] Assemble the actual evidence in an orderly manner. Missing documents should be named and submitted later, instead of estimating figures or omitting individual income.
Answer court queries in good time. A begun collection is not a grant; a specifically set deadline for evidence must actually be processed. Also ask before an instruction which costs may still arise in the specific course. This article does not promise completely free comprehensive representation across the board.
Do not move the start of advice forward unnoticed
If the prerequisites are met, the district court can issue an entitlement certificate (Berechtigungsschein) with the matter precisely specified. Whoever contacts an adviser directly must observe the deadline in § 6 BerHG for a subsequent application: no later than four weeks after the start of the Beratungshilfe activity. [BerHG6]
Therefore clarify at the first contact in which framework advice is to be given, when the activity begins and who will process the application. A subsequently planned application does not render an activity already begun temporally without consequence.
Hypothetical completion of the preparation
In the invented case the tenant brings the claim, a payment list and financial evidence to the appropriate place. Any known deadline in the rental dispute is stated immediately; the question of legal aid does not replace separate handling of that deadline. In the end the matter, the evidence situation, the local route and the start of advice are clarified. Approval and the substantive rental law question are decided separately in each case.
