After the first viewing Elisa signs a purchase offer later that same afternoon. The next morning she notices that a question important to her is still open. She now wants to know whether she can “in any case withdraw within a week”. In the fictional Austrian case the answer depends on the specific sequence and purpose of the acquisition, not merely on the word Kaufanbot.
This article contains editorial guidance for timely review. It does not provide an individual declaration of withdrawal and does not assess the binding effect of any particular document or all other possible rights to a solution.
Gather four facts before the consultation
Elisa notes when she first viewed the property and when she made which declaration. Added to that is what she intends to acquire and what residential purpose it is to serve. She presents exactly the version submitted together with annexes, not a later edited draft.
The editorial recommendation is a brief factual chronology with existing messages and documents. An imprecise recollection such as “That was sometime at the weekend” is not replaced by a self-estimated date. If a date is uncertain, this is explicitly stated.
The special right requires more than a spontaneous regret
§ 30a KSchG concerns a consumer declaration on the day of the initial viewing: acquisition of certain residential or usage rights, an apartment, a single-family house or a suitable plot for single-family house construction. The acquisition must serve the urgent residential need of the person or a close relative. [KSCHG]
The ministry explains that this special right can also be considered where the counterparty is a private individual. However, it is not a general right of withdrawal for investment or holiday properties. [MINISTERIUM] Elisa therefore has her factual constellation examined, instead of classifying the case solely according to the person of the seller.
If the declaration had been made only on a later viewing day, the prerequisites for this special right would be different. This does not imply the blanket assertion that under no other legal aspect would a solution be possible then.
Do not calculate the deadline from a marketing sentence
§ 30a states one week after the declaration. The period begins only upon receipt of her duplicate and a written withdrawal instruction; the right expires at the latest one month after the first viewing. [KSCHG] For that reason Elisa also records the actual receipt of these documents.
In an ongoing case she does not wait until the presumed end of the month. A weekend date or a missing page becomes a concrete point for review. The article deliberately does not calculate an individual last day from incomplete information.
Distinguish withdrawal from a mere request for release
If a corresponding right exists and is to be exercised, the declaration must be comprehensible as such. Our practical recommendation: have the appropriate recipient and timely documentable transmission clarified immediately. A sentence such as “Maybe we’ll think again” should not be treated unexamined as a clearly exercised withdrawal.
The ministerial information also distinguishes the real estate transaction from the brokerage contract. A withdrawal only from a brokerage agreement is not automatically understood as a solution for every purchase offer. [MINISTERIUM] The relation to the special right and declarations already made therefore also belongs in the concrete review.
Do not change payment and other commitments on the side
§ 30a excludes the effective agreement of certain earnest-money, penalty or down payment arrangements before the expiry of the withdrawal period. [KSCHG] An already asserted claim is nevertheless not finally classified solely on the basis of its heading; Elisa also submits this document.
In addition she keeps an eye on her own financing and planned service-provider orders. A possibly existing right of withdrawal from the real estate transaction does not automatically answer every question regarding an already concluded loan agreement or a separately ordered removal. The article does not guarantee a general free termination of all accompanying transactions.
Avoid the initial mistake for the next decision
In the example Elisa receives a prompt review of her specific declaration. Its result remains individual; the fictional story does not claim an already definitely won legal dispute.
For a future viewing she places important open questions before a binding declaration. The special right of withdrawal protects, under its conditions, against a hasty housing decision. However, it is not a reliable method to assume initially unknown conditions and only examine the entire undertaking afterwards.
