Reader question: Which announcement and which reason authorise entry to my Austrian student hall room?
In the afternoon a notice is posted in the Austrian student hall: the next morning the cleaning service is to enter your room as well. You will not be there that day. Instead of merely debating whether there is a master key, you check the announced action against the special rights of hall residents.
The article concerns hall places within the scope of the Studentenheimgesetz. A private shared flat room or any furnished apartment does not thereby become a student hall. [StuHG1]
The room may generally remain locked
§6 paragraph 1 number 2 grants the right to keep the room with the hall place locked at all times. The rights stated there may not be restricted by the usage contract. At the same time the provision allows access for cleaning and repair work by persons authorised by the hall operator. [StuHG6]
There are therefore several concrete questions: Is it actually such work? Which person or company is authorised for this? How was the appointment announced? Possession of a key does not fully answer these questions. Equally, keeping the room locked is not a blanket reason to permanently prevent a properly prepared necessary task.
Make the written announcement temporally verifiable
For this entry §6 requires a written announcement at least 48 hours in advance. [StuHG6] Secure the actual notice with an identifiable time. Also record for which starting time the entry is announced. A subsequently differently recalled noticeboard posting is not as good a starting point as an existing dated communication.
In the invented case the room cleaning is announced in writing on Tuesday at 16:00 for Wednesday at 10:00. Eighteen hours lie between. For the described ordinary cleaning occasion that is shorter than the statutory 48 hours. The resident points out the specific times and asks for a correspondingly announced appointment. The example does not adjudicate every conceivable service or evidential question.
For an alleged danger examine the other legal ground
To avert an imminent danger no announcement before entry is required under §6. [StuHG6] This exception is not equated with an ordinary cleaning schedule. Conversely, in the case of a genuinely imminent danger one does not first wait for the end of a normal announcement period.
The article does not provide a technical hazard diagnosis. Note what was specifically communicated or observed, and contact the competent assistance in the event of acute danger. The subsequent documentation should clearly distinguish between ordinary work and the alleged reason of danger.
Coordinate jointly in a multi-occupancy room
In a multi-occupancy room the rights named in §6 paragraph 1 numbers 2 to 4 must be exercised with the agreement of the residents. [StuHG6] Therefore pass on a confirmed work appointment to the other person and agree practical points: reachable contact person, affected areas of the room and freely accessible work area.
An arrangement among room-mates does not replace the necessary announcement by the hall operator nor their authorisation of the service. However, it prevents one person from promising a previously clarified appointment while the other is left with contradictory information.
Proceed with a specific follow-up question
Record in writing which reason was given, when the notice was received and which appointment is confirmed. Ask specifically about missing details and the need for a new announcement. In case of further dispute the special conciliation route for the hall relationship can be examined; a legal decision is not replaced by an improvised personal confrontation at the room door.
