You want to buy a share in an Austrian property. In addition to the desired residential use, you now learn that a partition action (Teilungsklage) is pending between the existing co-owners. The seller’s side explains that the dispute will be resolved once you step in. Before committing you need a legal review of exactly that assumption and of the current procedural status.
Start with the claim sought and the procedural status
Our editorial recommendation: Have the existing action, court decisions and other relevant procedural documents organised and made available. A notice of “dispute between the owners” does not describe the type of partition sought nor any decision already taken. Also explain to your advisers what you intend to achieve with the share.
Section 830 ABGB generally enables a co-owner to demand the dissolution of the community, but mentions untimeliness or detriment and an appropriate postponement. [TEILUNG] From this no duration of continued community is guaranteed by this article, nor is any particular immediate realisation. The actual claim and its prior handling are decisive.
Do not expect an automatic fresh start through the purchase
Section 234 ZPO provides that the disposal of a matter caught up in litigation has no effect on the proceedings. Without the opponent’s consent the acquirer may not enter as the principal party. [PROZESS] A purchase of a share will therefore not, without examination, be treated as termination of the old proceedings or as a free assumption of the conduct of the proceedings.
Have it explained whether and to what extent your planned acquisition would be affected by the specific litigation. Discuss what role you can actually obtain, what further cooperation is required from the seller’s side and how new procedural information will reliably reach your advisers. A private promise does not replace a clarified procedural position.
Read the land register trace together with the case file
Provide the advisers with the current land register status and the temporally relevant acquisition documents. Where there is a note of the partition action, the content, rank and affected share must be assigned precisely. The OGH describes the purpose of such a note as excluding the good faith of a single successor in title and securing enforcement of the partition judgment against an acquirer who is correspondingly aware. [ANMERKUNG]
The specific decision also shows why mere buzzwords are not enough: there a particular earlier priority notice of ownership with later justification meant that the title issued against the predecessor could not be enforced against the acquirer. [ANMERKUNG] This result is not transferred to your purchase. Neither “note present” nor “older document present” replaces an individual examination of rank and effect.
Test your housing plan against possible procedural outcomes
For the general basis of use of a mere share the linked co-ownership article is helpful. Here the ongoing question of dissolution is added. Compare what use you are to acquire today and which later development your purchase would depend on.
If your plan is only viable if the community remains unchanged permanently, this precondition must be expressly advised on. That you should retain a particular flat or pay out another person later does not yet prove a suitable judicial or consensual outcome. An hoped-for agreement is not documented as already concluded.
Hypothetical case: A new person is supposed to calm the old dispute
An interested party is offered the chance to buy a half share and to continue using the rooms previously used. The seller’s side considers the change sufficient for the other co-owner to withdraw her partition action. A corresponding agreement does not yet exist.
The interested party first has the procedural status, land register situation and her own time of acquisition assessed together. A desired termination of the dispute is then treated as a separate precondition to be clarified. It does not justify a secure move-in over several years as long as her planning is based solely on the unconfirmed expectation of withdrawal. The case confirms neither a particular success of the action nor an unsellability of the share.
Bring the result together before making the purchase decision
You need an understandable explanation of the acquired share, the affected procedural position and the significance of possible decisions for your purpose. Financing and contract preparation should be based on the same documented position. New court steps will be reported before the next binding acquisition step. A favourable price does not make the open question of dissolution irrelevant; it must be assessed as part of the acquisition actually offered.
