An Austrian plot of land appeals to you, and the price per square metre initially fits your budget. That does not yet determine whether you can realise your home there. Before committing you need a shared picture of the rights being acquired, the actually feasible proposal, the construction required and the expenses clarified for it. This article guides you through this entire purchase decision.
Local spatial planning, building and connection rules must be checked for the actual location. The explicitly designated Lower Austria building-plot example is not transferable to other federal states.
Specify which home should be built on which plot
Our editorial recommendation: Describe the functions that are essential to you before commissioning a detailed design. Which use must definitely be possible? What accessibility and outdoor space do you need? Which wishes might change? Link this information to the clearly identified plots in the listing.
Have the rights to be acquired and existing encumbrances explained on the basis of the land register together with the relevant documents. You do not confirm boundaries and available space yourself from a fence. The results of these individual checks must then be brought back together to the same object of purchase.
Check the building proposal against the applicable local basis
The official overview distinguishes between zoning (Flächenwidmung) and development planning and refers for inspection to the locally competent authorities. It also recommends asking about planned changes. [PLAN] Therefore provide the relevant current documents to your specialist planner and specify the decisive building proposal. A planned change is not assessed as an already applicable basis.
In Lower Austria the separate building-plot question is added. §11 NÖ Bauordnung describes different ways of origin and prerequisites. [NOE] For your overall purchase it therefore remains open whether and how the desired project may be realised. A single positive conceptual allocation does not end this review.
Link soil assessment and the actual building idea
The official information recommends checking location and shape against the feasibility of the development wishes with suitable specialist planning before purchase. It treats soil conditions and groundwater as essential topics of technical clarification. [EIGNUNG]
Describe the brief for the assessment with the planned building and its decisive characteristics. Ask which existing investigations are usable for this, what their limitations are and which supplementary findings are required. A dry day visit is not used as evidence of load-bearing capacity. The article does not design a foundation nor does it state a blanket surcharge for a plot on a slope.
Turn “serviced” into a declared level of completion
The official connection information refers to the location and scope of the servicing as well as possible additional construction costs. [ANSCHLUSS] Have it confirmed for your project which connections are actually present or can be constructed, where they are located and what further outstanding effort is involved.
Assign access and required rights within the same project. Separate already paid items, current information and still unknown amounts. Ask the municipality, utilities and specialist planners each for their actual area of responsibility. A neighbouring pipe or an informal seller’s figure is not accepted without verification as a complete construction information.
Compare the prepared overall project
Two plots are offered hypothetically. The first costs less but for the specific house desire still requires unresolved connection works and an additional soil assessment. For the second several services are comprehensibly specified. The interested party therefore compares not only the price per square metre.
She puts together purchase and incidental acquisition costs, the clarified construction expenses and the still open project assumptions. She then checks with the appropriate specialist bodies which answers are missing before committing and how remaining uncertainty should be dealt with financially and contractually. Unknown costs are neither entered as zero nor confirmed by an invented contingency.
A complete decision can lead to purchase, to an altered proposal or to abandonment. It should explain why this particular plot actually carries your project.
