The two statements do not automatically go together
Bauland describes a zoning designation (Widmung). The status of being a buildable plot (Bauplatzeigenschaft) has its own requirements. § 11 NÖ Bauordnung 2014 lists several ways it can arise: a Bauplatzerklärung, certain historical changes to parcels, certain existing buildings under the statutory conditions and other expressly regulated cases. Therefore neither “There is no new decision, so it cannot be a buildable plot” nor “It is bauland, so everything is settled” is a reliable conclusion. [BO11]
Particularly instructive is the historical development case: the law does not refer to any building that happens to exist today. Among other things it specifies an uninterrupted Bauland zoning (Baulandwidmung) since 1 January 1989 and a building that had been approved by the building authority on that key date; certain types of buildings are excluded. today’s photograph cannot prove that history. [BO11]
Anna therefore does not need a general assurance about the surroundings, but the nachvollziehbare assignment of her parcel to one of the routes of origin. An existing file number can achieve substantially more in this regard than a pretty aerial photo.
What the municipality should be able to answer
For the conversation Anna compiles the parcel number, cadastral municipality and known earlier divisions. She asks whether and on what basis the buildable plot status applies to this exact current parcel configuration. An old declaration for a larger parcel will not be adopted without assignment to the present situation.
If the status is missing, the next question is not merely the price of an application. Under § 11 paragraph 2 the requirements concern, among other things, the connection to the public traffic area, buildability with regard to form, condition and size as well as planning determinations, a possible servicing zone and the purpose of a building moratorium. Where servicing is via another parcel the law, under the relevant conditions, requires an officially registered right of way and utility easement; an access that is actually used for driving does not answer that by itself. [BO11]
This explanation is limited to Lower Austria. A term from an advertisement in another federal state does not provide a substitute.
Anna does not yet decide between two houses
In the fictional case a prior parcel change emerges. Whether the current buildable plot status follows from that remains open for the time being. Anna therefore does not postpone the entire purchase across the board, but has this concrete open precondition examined professionally in the further purchase preparations. She orders the elaborate house design only once the basis is clarified.
The result of her work is a brief parcel note: current configuration, established or unresolved buildable plot status, related files and next competent authority. It also explicitly states that the buildable plot status is not yet a permit for her desired house. Size, use and execution of the project require their own examination. In this way the apparent verbal dispute becomes a usable decision about the next investment.
