During the viewing you notice an advertising installation or another facility on the building that is operated by a third party. The sales page refers to regular income. For your purchase decision you also need the associated rules of use, obligations and effects on any work you will carry out on the building.
This article is an editorial preparatory aid. It does not assert an automatic transfer of any specific usage contract nor any general right of termination. The concrete contract, any registered rights and the purchase structuring must be examined by a specialist.
Connect installation, area and contracting parties
Request the complete relevant documents and a description of the area actually used. Who owns the installation, which areas are claimed and how does the user side obtain access? A visible installation and a single payment into the account do not explain the full scope of use.
Keep your own observations and documented agreement separate. A larger actually used area may prompt a targeted query. By itself it does not yet prove a contractual breach. The legal classification belongs in the review of the full basis.
Consider income only together with counter-performance
What payment is made for which period and what tasks accompany it? Ask about promised access, maintenance, possible costs and the handling of damage. The article does not set a customary remuneration or return.
Distinguish confirmed payments from the expectation that the contract will be continued unchanged. Even an operation that is trouble-free today is not a guarantee that your later roof work will be possible without coordination. Your own perspective on the building belongs in the review from the outset.
Hypothetical case: roof renovation and third-party installation coincide
A buyer wants to repair the roof shortly after acquisition. The sales page simultaneously advertises a third-party operated installation as an additional income. The buyer has not yet clarified what accesses, removal or coordination obligations are associated with the installation.
He therefore has the usage contract and his planned construction schedule examined together. For a possible temporary removal, responsibilities and costs are clarified on the basis of the documents. The example does not promise a unilateral removal option and does not decide any compensation claim.
Have your future role expressly determined
Discuss with the contract advisory which position you should obtain after the purchase and which declarations or further prerequisites are necessary for the intended transfer. A general sentence that the income will belong to you in future should not be treated as a complete contract takeover.
If you do not wish to continue the third-party use, have this wish checked for its actual feasibility before giving your consent. Do not at the same time expect the immediate end of use and permanently unchanged income from it.
Your decision outcome links spatial use, financial performance and your own plans. That way you can assess the offer price under the clarified conditions. The third-party used area is considered as an ongoing relationship and not merely as an additional amount in the exposé.
