Reader question: How do I clarify ownership, return and data handling before taking over a privately left router?
After moving out there is still a router on the shelf. The new tenant would like to take it over. The letting party only knows that the device was used by the previous person. Before anyone connects it, resets it or gives it away, a clear decision about this exact device is needed.
Describe the find without opening others’ settings
Note the location, visible model designation, existing accessories and the actually known background. A photo for identification does not need to contain legible access data. Do not publish device stickers with passwords in the house chat and do not attempt to log in with someone else’s credentials.
Our organisational recommendation: Ask the previous tenant specifically whether the device belongs to them, must be returned or was deliberately offered for takeover. The statement “it’s still there” allows several answers. Perhaps the device was simply forgotten; perhaps there is a return agreement with a provider. As long as the attribution is open, a private passing-on will not be treated as completed.
An assumed abandonment of ownership is not sufficient
§ 959 BGB requires for ownerlessness of a movable thing that the owner abandons possession with the intention of relinquishing ownership. [BGB959] The mere observation of a left-behind device does not establish this intention. A note from the property management also does not replace a clarified power of disposal over another person’s individual device.
If the ownership question cannot be clarified or there are conflicting statements, the further legal handling will be examined separately. A self-imposed short collection deadline does not automatically authorise sale or disposal.
Distinguishe three possible routes
Return: The responsible person clarifies the actual recipient, the intended return route and the device identification. Any random address or a parcel without traceable attribution is not a proper conclusion. Keep a handover or shipping receipt for the process.
Private takeover: The previously authorised person and the taking-over person agree on the device, accessories and the agreed condition. Acquiring the item does not yet answer the question of a separate internet contract or activation. Such services must be clarified with the actually responsible provider; this article does not claim transferability of an ongoing connection.
Unresolved whereabouts: Name the open issue and a contact for queries. An unknown unit is not to be reconnected on a trial basis. If the device may belong to existing residential functions, the responsible support is contacted first. A personal router and a centrally managed house function must not be treated the same solely because of similar enclosures.
Organise data handling before passing on
The BSI generally points out that factory settings alone may not guarantee the irretrievable removal of sensitive data on some devices. [BSIDATEN] This does not imply here a claim about stored contents of this router nor a blanket recommendation to overwrite or destroy unknown devices.
The authorised previous user should clarify, based on the specific model and possibly with provider or manufacturer support, what preparation for return or transfer is intended. Any required personal information is secured beforehand by permissible means. Personal master passwords are not passed on as part of the device accessories. Nor does an alleged shortcut for a function test using someone else’s accounts belong to the handover.
A case in which a rapid takeover fails
In the fictitious case the former tenant states on enquiry that the router must be returned to a provider. The new tenant had already prepared a purchase offer. They withdraw it; the parties instead clarify return and data preparation with the responsible body. The available power supply unit is assigned to the device, shipment is completed later with a receipt.
The useful completion information therefore is not “router reset”. It describes who was entitled to decide about which device, what disposition was agreed, who took over the required data handling and whether the actual handover or return was confirmed. No technical erasure certification is thereby claimed.
