The acceptance letter from your university has arrived and a hall place is available. Before you compare only the monthly payment with a shared flat room, check for which period the place is offered and how you can later extend or terminate it. This article deals with hall places within the scope of the Austrian Studentenheimgesetz. An ordinary private flat does not become a student hall merely because students live in it.
First assign the actual hall place
§§ 1 and 2 Studentenheimgesetz regulate the framework for the allocation of places by hall operators and the operational form set up specifically for that purpose. Therefore make clear who your contracting party is and which place is being offered. The advertising description “studentisch” alone should not replace the examination of the contractual framework. [RAHMEN] [HEIM]
Our practical recommendation: Note whether you are getting a single room, a place in a shared room, or a unit with different fittings. Communal use, equipment and the actual move-in date belong to your comparison. The information that a bed is still free does not yet confirm every desired scope of services.
Read the contract and the hall statute together
§ 5 requires a written usage contract. Its particulars include, among other things, the period, the possibility of extension, termination periods, payment and deposit. The hall statute is part of the contract and must be provided at least electronically. [VERTRAG]
Therefore keep not only the booking confirmation. Read the full contract together with the corresponding version of the statute. Arrange ongoing charges, additional services and initial payments according to their significance. Ask about unclear items before committing. A cost list from another hall is not proof of your offer.
The hall year need not correspond to your semester
Under § 5a a twelve-month contract period is generally envisaged; the operator uniformly sets the beginning and end of the hall year in the statute. The law includes, among other things, deviating possibilities for entry during the hall year, individual durations and, on request, shorter stays. Freshers may explicitly demand a contract duration of 24 months; they must be informed of this demonstrably. [DAUER]
Therefore mark your actual contract start and the agreed end. “I only study here until June” is not a sufficient description of the contract duration. If you expect a shorter stay, explicitly ask for the agreement provided for that and record which alternative is actually being offered.
Provide for an extension not just in your head
§ 5a also governs the written wish to extend and possible deadlines in the statute. There are further legal requirements and limits for the claim, for example regarding the duration of studies; additional criteria apply to federally funded halls. A single promise therefore does not constitute an unexamined accommodation promise for any later course of study. [DAUER]
As an organisational aid, set a reminder before the relevant deadline. Collect the concrete proofs required and secure your declaration with a date. If study, funding status or the prerequisites named in the statute change, that belongs in the next review. An already noted interest does not automatically replace the required written notification.
Example: The place of study changes earlier than expected
In the fictional case Leni moves into a hall and later receives a place of study in another city. She does not simply stop payment because she no longer uses the room. First she clarifies the contract period, the usual termination rule and the verifiable change of place of study.
§ 12 paragraph 3 provides for termination by the resident at the end of the following calendar month, but allows a longer agreed period. For the end of a semester the law names special latest declaration dates: 30 November and 30 April respectively. In addition, in the case of proven important reasons, including a change of place of study, the shorter statutory termination possibility is to be examined. The actual end of the semester is stated in the hall statute. [ENDE]
Leni has the appropriate end clarified with her concrete dates and documents the declaration, proofs and return. The fictional story is not a finished termination calculation. It shows how the study plan and the housing contract are brought together, without assuming ordinary residential lease deadlines or a mere move-out date as a sufficient solution.
