Reader question: How do I prepare a possible appeal (Rekurs) against a judicial substantive order without confusing the bringing of the municipality (Gemeinde-Anrufung) and remedies?
In Austrian tenancy proceedings there is now a judicial substantive order (Sachbeschluss). You disagree with part of the decision. Previously you may have pursued a municipal decision by bringing it before the court. That earlier procedural act is not simply repeated for the new judicial decision.
This article deals with a substantive order in proceedings under §37 MRG. The decision on the matter is issued there under paragraph 3 number 13 as a substantive order. [MRG37] A judicial judgment from an ordinary civil process and a merely procedural order may follow other rules.
Classify the actually served decision
Secure the complete order, the information on remedies (Rechtsmittelbelehrung) and the service documents. Which applications were decided, which parts dismissed and what is the subject-matter of the proceedings? Describe the outcome first before you write a new long account of the facts.
Our preparation recommendation: next to each contested part of the decision set out the specific criticism. Is it about legal assessment, procedural conduct, factual finding or an invoice? A mere repetition of the original request does not yet make clear why the court’s reasoning should be changed.
Determine the special time-limit correctly
§37 paragraph 3 number 15 specifies four weeks for the appeal against a substantive order and the corresponding answer to the appeal. The general point of attachment for service is regulated in the AußStrG. [MRG37][AußStrG46]
Do not transfer these four weeks to every document bearing the heading “Beschluss”. Submit service and decision type immediately for the specific calculation of the time-limit. A still outstanding reply from the opposing party or a private request for a renewed explanation does not extend the time-limit for remedies as a mere organisational assumption.
Link decision, complaint and objective
§47 AußStrG provides for filing with the court of first instance. The remedy must designate the contested decision and make clear for what reasons the party considers itself aggrieved and what other decision it seeks. [AußStrG47]
Prepare this linkage deliberately: What does the relevant paragraph say? What specific error is alleged? What should the outcome be in your view? Have permissible content and an effective method of filing checked in good time. A general e‑mail to the letting department is not a confirmed substitute for this.
Do not treat new evidence as an arbitrary second start
§37 paragraph 3 number 14 limits new facts and new evidence in the appeal; excepted are the purposes there described for demonstrating or refuting grounds of appeal. [MRG37] A document discovered later therefore belongs to a professional assessment and must not be appended without comment to a completely newly recounted application.
For each document mark whether it was already before the first instance, where it was referenced in the file or why it is now being submitted. The distinction assists the legal examination. It neither justifies omitting an important factual document nor a promise that every new document will be admissible.
Fictional case: The invoice was already in the file
A tenant party believes the court misassigned an invoice that had already been submitted. They therefore cite the existing file reference and the specific part of the decision. In addition they later find another document. This is identified as a later-found document and its procedural admissibility is examined separately.
This way a possible criticism of the handling of existing case material and the new submission are not mixed. The example says nothing about whether the appeal will be successful.
Organise further processing with binding clarity
§37 contains special rules on representation and further rules for higher instances. [MRG37] Clarify who will effectively prepare and file the specific appeal; an earlier general consultation does not confirm this. Keep proof of filing and further judicial services with the case. The appeal is a specific, time‑bound task with a comprehensible reasoning, not a mere extension of the previous correspondence.
