Name the reviewed contractual framework first
This article concerns a price regulation within the scope of the Austrian BTVG. Whether your specific overall transaction falls under it or whether further price provisions apply must be clarified professionally beforehand. A mere heading Bauträgervertrag does not replace this examination.
§4 Absatz 3 BTVG allows, starting from a base price, a price determination dependent on certain cost factors. For validity the provision names precisely defined factors and an upper limit or a corresponding permissible determination according to the WGG. If the agreement is ineffective, the provision provides that the base price applies. [PREIS]
A calculation rule needs verifiable inputs
Please explain the contractual advice, initial price, factors, reference points and limit based on the actual clause. Which item may change for what reason? To what is the change applied? What information or evidence must be available for the calculation?
Our editorial recommendation is an example calculation with exactly the reviewed contractual components. A self-invented general construction cost surcharge would not be an appropriate review. The article also does not confirm any particular index or any specific adjustment formula.
Fictitious case: the bank calculation today considers only the base price
A household plans with €350.000. The contractual rule still to be reviewed could lead to a higher total price. In the financing overview, however, only the initial figure appears; a privately desired buffer is simultaneously budgeted for furnishings and price increases.
Before a binding declaration the household has the clause examined and discusses the actually relevant price framework with the bank. It allocates each available amount only once. The freely invented initial figure is not a market value and not a legal statement about an allowable increase.
Do not let special requests disappear into the same uncertainty
Separate a possible adjustment of the agreed scope from additional services that you wish to commission yourself. A desire for a higher-quality floor may have a different cause than an asserted cost development. For your calculation it must be recognisable which change belongs to which service.
For each change have the appropriate contractual version and its effect on the price framework explained. An upper limit for a specific formula should not be treated without verification as a cap on every other item additionally triggered by you. Likewise an agreed base price alone does not confirm an arbitrary subsequent claim.
Have the calculation method checked in the event of a subsequent claim
If a higher amount is demanded later, secure the clause, invoice, calculation bases and status of performance. Ask for the concrete derivation and obtain professional advice before you decide on payment or withholding. This article does not entitle you to unilaterally reduce payments or to a blanket refusal of an instalment.
Your purchase decision is soundly prepared if you understand the reviewed adjustment mechanism and the financing framework needed for it. The decisive result is not an allegedly safely low initial price, but a reliable understanding of the price commitment actually assumed.
