A house is being offered for sale after a death. During the viewing you are accompanied by a person who intends to inherit later. They want to sign the purchase contract “for the family”. Before you plan your own move around that, it must be clear who is entitled to act at this stage of the proceedings and what prerequisites exist for the planned disposal.
First establish the stage of the proceedings
The official overview explains that the probate proceedings (Verlassenschaftsverfahren) are conducted by notaries on behalf of the district court. At the end there is the confirmation of inheritance (Einantwortungsbeschluss), which shows the allocation under inheritance law. [VERFAHREN] Therefore ask first whether you are preparing a purchase from an estate that is still dormant or a purchase after the Einantwortung has taken place.
A family declaration as to who should receive the house is not yet a verified power of representation or title document for you. You do not need private insight into all family matters. The legal advisory office in charge of the purchase should determine and check the evidence required for this acquisition.
Representation and approval are different questions
Section 810 ABGB regulates, among other things, representation by heirs before Einantwortung who adequately prove their right of inheritance upon taking up the estate. If several are entitled, they generally act jointly, unless otherwise agreed. The provision requires, in its statutory cases, a court approval for disposals outside the ordinary course of business; it also contains an inventory requirement where an inventory is to be expected from the files. [VERLASSENSCHAFT]
This summary does not determine which specific signature will suffice in your case. Ask for the review of representation, necessary approval and their evidence as separate issues. An apparently clear price does not answer any of these questions. The involvement of a notary’s office does not automatically mean that every task required for the purchase has already been commissioned or completed.
A hypothetical purchase with an overly early move-in date
An interested party agrees orally to take over the house in December. The contact person expects to be the sole heir by then. In fact, the stage of the proceedings and representation have not been clarified when the contract is drawn up. The interested party already wants to terminate their current tenancy.
The useful next step is a professional clarification of status for the planned purchase: From which assets is the sale being made, who is acting on behalf of those assets, which further prerequisites remain outstanding and how should any delay be handled? The desired December date is recorded as a planning wish, not as proof of a legally secured handover.
Your preparation remains focussed on the purchase
Keep together the property, the agreed scope of services, the current draft status and the responsibilities. Ask the contract adviser for a comprehensible sequence in which outstanding prerequisites are visible. They should also explain how a binding declaration, the payment and a possible unwind (Rückabwicklungsfall) should be structured. This article does not formulate any contractual term for that purpose.
If the Einantwortung occurs during the preparation, the new situation must be taken into account in the purchase processing. The earlier assumption about representation must not quietly become the current basis. Have it confirmed which documents are now authoritative.
You do not have to become an expert in inheritance law as a buyer. However, you should be able to recognise whether a family intention, an established representation and a court decision required for the specific sale are being confused. If a fundamental prerequisite remains open, that uncertainty belongs in your purchase and scheduling decision.
