When letting a flat for the first time, people often think first of photographs, the rent and viewings. The questions that are more important in the long term begin earlier: Which rules apply to this flat, which items are actually included in the letting and who will deal with enquiries after the tenant has moved in? An advertisement can describe these basics, but it cannot replace them.
The property needs a reliable initial description
Record which flat and which ancillary areas are to be made available for use. Note whether, for example, a cellar room, a parking space or appliances are included and which parts may only be used jointly. Reconcile your description with the existing documentation. A room that has been used in a certain way for years is not for that reason alone legally suitable for every intended use.
Editorial recommendation: Keep a small property file with two columns: “occupied” and “to be clarified”. A plan, an invoice or a statement from the management have different evidential value. Therefore note the respective source. This prevents an orally transmitted assumption from accidentally becoming a contractual promise.
Check the legal framework before deciding on the price
In Austria it is important for rights and obligations whether the Mietrechtsgesetz (MRG) is fully, partially or not applicable. The official rental information states these differences and recommends clarification before concluding a contract. The classification is not a mere stylistic question between old building and new build; the specific property and its history must be examined. [AT-MRG]
For a professional examination, make the existing property and contract documents available. Do not only ask: “What price can I demand?”, but also: “Which information is missing for the legal classification?” A sample contract used in another building is not proof that the same provisions are appropriate here. This article does not provide an automatic classification or a rent calculation.
Clearly separate service and costs
Define which amounts are intended for what and which utilities the tenant must organise themselves. Do not present one-off payments as ongoing income. Also plan your own expenses that will arise before any possible receipt of payment: preparation, necessary repairs or a temporary vacancy.
Example, editorially invented: The refrigerator is to be included in the letting. Before the advertisement you clarify its condition, record it in the inventory list and note to whom a fault should be reported. Without this preparation the advert, the contract and the handover protocol can later convey three different ideas. A precise description is more helpful here than the word “fully equipped”.
The transition from conclusion to everyday life
Plan the handover so that condition, keys and meter readings can be documented without time pressure. Agree which functions should be tried together. A factual documentation separates existing signs of wear from outstanding works. A repair appointment that is still pending should be recorded with the person responsible and the planned next step.
At the same time provide a clear contact for routine notifications and explain how to proceed in the event of acute dangers. You do not need a large management system for this. A clear case number or a well-kept folder is often sufficient, as long as messages can be retrieved and representation remains possible. Personal data should only be processed for understandable purposes and be accessible to the persons actually responsible.
Treat a defect report as a task
When a message arrives, acknowledge receipt and clarify the nature of the fault. Separate the technical handling from any still-open question of costs. Document whether a company was commissioned, when the appointment takes place and whether the reporting person is informed of the outcome. An order is not yet a completion notice.
Our editorial recommendation for the first month of letting: Check organisationally after a short time whether billing, contact channels and agreed outstanding works have been clarified. This does not give rise to a right to enter the flat without cause or agreement. The check primarily concerns your documents and the communication.
What may still be open before publication
Not every minor detail must be finalised in the first draft. However, decisive details about use, costs or condition must not be presented as certain when they are still unclear. A good start means being able to make reliable commitments and keeping remaining questions visible. In the case of legal particularities, qualified advice and an appropriately reviewed contract belong to the preparation.
