You want to sell a German residential building whose renovation was subsidised under KfW 261. In your preparations the question of what happens to the loan is already on the table. In addition, the existing subsidy with its usage and evidence obligations must be addressed. The outstanding loan balance alone does not fully capture this second task.
Find the actually associated commitment first
Our editorial recommendation: Gather the commitment, the funding conditions in effect at the time, the renovation evidence and the current processing status together. Note the programme number, date of application receipt, completion and, if applicable, any confirmations still outstanding. That allows the financing partner to check the concrete situation.
The following source references explicitly relate to the KfW-261 information sheet (Merkblatt) as of September 2026, valid from 24.09.2026. It is not asserted that this version retroactively replaces every older commitment. A subsidy under a different programme is also not treated the same just because the keyword “energetic” appears.
What the current version makes visible for a sale
The mentioned information sheet requires at least ten years of appropriate residential use after completion. If a disposal takes place within this period, purchasers must be informed about the subsidy, the usage obligation and the aforementioned prohibition of deterioration. Certain changes of use, cessation of use or demolition must be reported immediately; KfW can then reclaim proportionately. [KFW261-M09-2026]
This article does not automatically equate sale with cessation of use. Which provisions your case triggers and how the required notice is implemented in the sales process will be coordinated on the basis of the associated conditions. This article does not provide contractual wording.
The documentation question remains after the money question
The version also specifies documents that must be retained and produced on request for ten years after the loan commitment, even after full repayment. These include in particular the specified technical evidence, invoices and proof of payment. [KFW261-M09-2026] The start and purpose of this retention period are not to be confused with the start of the aforementioned residential use period.
Therefore prepare two traceable sets: the documents required for your own evidence obligations and the property information coordinated with the purchaser side. Which originals go where will be clarified concretely. Handing over the only existing set of your own evidence documents in full would not be a convincing completion arrangement.
An imagined sale after subsidised renovation
A female owner has asked about the loan redemption process and then wishes to leave all subsidy documents to the purchaser only. During the separate subsidy reconciliation she recognises that notices and evidence also have to be organised.
She has the conditions applicable to her commitment confirmed, coordinates the information to the purchaser with the advisory party and documents the remaining set of her own evidence. The article does not calculate a reclaim nor does it promise a transfer of the loan. The result is a sales file that brings financing and subsidy each verifiably to a close.
