For part of the rent claims an assignment has been agreed. The management should communicate the new payment address, while the previous account ledger continues unchanged. This can lead to a divergence between the legal scope of the claim and the practical handling. A clean transition therefore begins with the content of the transfer, not with the exchange of the IBAN.
Define exactly which claim is transferred
§ 398 BGB describes the contractual transfer of a claim to a new creditor. [UEBERGANG] Present the actually agreed basis for professional review: which claims, periods and amounts are covered? Does the transaction concern already arisen or future claims?
The assignment of a rent claim is not treated here uncritically as a transfer of the entire landlord position. Clarify separately who handles repairs, who may make contractual declarations and who manages incoming payments. These duties must not accidentally disappear under the same new contact designation in the resident information.
Do not treat the notification as a non-binding message
§ 409 gives the assignment notification by the previous creditor a special effect vis-à-vis the debtor. Withdrawal is only possible with the consent of the person designated as the new creditor. [ANZEIGE] An unclearly worded circular should therefore not be sent before an agreement has been clarified.
Our editorial recommendation: prepare the specific scope of information with legal support. Name the covered claim and the relevant commencement in a comprehensible way. Unnecessary financing details do not automatically belong in the message to all residents.
Coordinate the transition month with both payment offices
§ 407 protects, under its conditions, payments to the previous creditor when there is no knowledge of the assignment. [ALTEZAHLUNG] A payment at the previous location is therefore not to be treated as if it had not happened solely from the perspective of the new account list.
Arrange organisationally how amounts mistakenly received in the old account are recognised and forwarded for review. This is not an automatic legal rebooking rule, but a way to bring the actual information together. Receipts, payment references and the declared status remain preserved.
Hypothetical case: two lists report the same month as outstanding
The new claim holder sees no receipt. However, at the previous payment office a transfer has been received that was still based on the earlier procedure. Both work lists initially trigger a reminder.
The management stops the unexamined double communication and collates the original receipt, the scope of the assignment and the time of notification. The legal classification clarifies the effect of the payment; the current account balance is only adjusted accordingly. The example does not decide which individual case has already been satisfied so as to discharge the debtor.
Provide a means of proof for enquiries
§ 410 contains rules on documentary proof vis-à-vis the new creditor as well as an exception for written notification by the previous creditor. [URKUNDE] The concrete information and its proof must therefore match. The management should know where to forward a legitimate query regarding responsibility for the claim.
Your result is a comprehensible transition with a checked scope, appropriate notification and a coordinated transition month. Only afterwards are dependent dunning processes brought up to date. Mere communication of a different account would portray the actual transfer of the claim and the protection of the paying person too imprecisely.
