A payment arrives but is not sufficient to cover all items recorded in the rent account. The payment reference specifies a particular month. The internal spreadsheet has so far always offset new receipts against the oldest balance. Before the next reminder is sent, the correct allocation must be clarified.
View the original receipt before the spreadsheet row
Secure the amount, date of receipt, paying person and full payment reference. Also check whether an accompanying message is present. A shortened display in an export table can lose text that is important for the allocation.
Place the asserted claims alongside: for each, the basis, period, due date and payments made to date. Disputed items are to be marked as such. The existence of a line in the account does not yet prove that this claim actually exists or is already due.
Do not replace a determination of application by convenience
§ 366 BGB governs the application (Anrechnung) where there are several similar obligations to perform within the scope described there. If the debtor determines at the time of performance which debt is to be discharged, that determination is decisive. Without such a determination, paragraph 2 contains a statutory order with several criteria. [ZUORDNUNG]
This is not a simple rule under which the oldest outstanding claim would always automatically be settled first. Therefore, in case of uncertainty, present a specifically designated payment reference and the affected items for legal examination. Whether the wording has the assumed meaning and which items are covered will be assessed on the basis of the whole transaction.
Do not deduct interest and costs in advance as a lump sum
§ 367 describes, under its conditions, an order for costs, interest and principal where payment is insufficient. Paragraph 2 deals with a different determination by the debtor and the possible refusal of acceptance. [NEBENFORDERUNGEN] However, the provision does not confirm that every reminder fee or interest entry recorded in the account would be justified.
Our editorial recommendation: first check the basis of an ancillary claim and only then its application. An internal flat rate without clarified entitlement should not, by automatic booking, create an apparently higher outstanding monthly rent. The article does not determine a general permissible amount for reminder fees or interest.
Fictitious case: A monthly reference contradicts the standard run
Lina receives a payment that is explicitly designated for a current rental month. The account also shows a disputed older statement and an internally applied fee. The worksheet would initially offset the receipt there and leave the current month marked as outstanding.
She pauses before sending the next reminder. With the original receipt, payment reference and claim documents she has the allocation checked. Afterwards the booking and the resulting balances are corrected or confirmed in a comprehensible way. The example does not decide the individual claims; it shows why an automatic offset does not replace a legal examination.
Track a correction up to the communication
If the allocation changes, dependent reminder statuses and prepared legal steps must also be reviewed. A corrected account table helps little if an old letter still asserts an obsolete arrear. Therefore secure the connection between receipt, booking and the communicated balance.
In cases of insolvency, special arrangements or multiple paying persons, further questions may arise. These are dealt with separately. Your conclusion is a documented payment receipt allocated in a legally appropriate manner. Only on this basis can it be sensibly decided which claim actually remains outstanding and how it should be further processed.
