Your home ties up a large part of your assets. An offer is intended to make money available from it today, while the repayment is linked to a later realisation. Before you evaluate the monthly amount, you need a clear explanation of the arrangement: which rights do you grant, what debt arises and when can a payment be demanded?
Do not use the product name as a legal check
§ 491 Absatz 3 BGB distinguishes certain residential property consumption loan agreements in particular. The description there links payments or loan disbursements to a subsequent residential property yield or right in the residential property and a repayment claim only after death, apart from the contractual breach constellation mentioned. [BGB491]
Whether your offer meets this definition must be checked on the basis of the full agreement. This does not lead to a blanket statement that all models advertised as reverse mortgages are identical or that all statutory protection rules would cease to apply. Partial sale, life annuity (Leibrente) and an ordinary loan must likewise not be equated solely because of a similar purpose.
Map out the actual flow of money
Have the one-off disbursement, possible ongoing disbursement, treatment of interest, fees and development of the outstanding obligation shown to you. Ask explicitly whether and how costs not paid regularly are later taken into account in the amount. The article does not assert any particular market-standard calculation.
For personal planning, set the actually available net amount against your own purposes. What additional living expenses should be covered from it and what funds does the property still need? A monthly payment is not proof that all other ownership expenses would be borne by someone else.
Read the case of early change especially carefully
What would happen in the event of permanent moving out, a sale during life, need for care or a desired alteration? Which breach of duty could trigger an earlier termination of the contract? These answers must come from the specific agreement and its specialist review. An advertising promise such as lifelong does not declare each of these situations.
Include a trusted independent person in the assessment if that helps you. They do not replace advice, but can identify ambiguities. The economic decision and a possible estate planning need each an appropriate classification.
Do not confuse a hypothetical need with an available offer
In the hypothetical case an owner wants an additional 400 euros per month of leeway. She first has represented which real disbursement would be available after the offered costs and how the obligation is to develop over several self-chosen points in time. Only after that does she compare alternatives for her housing and life planning.
The desired outcome is not an isolated maximised payout. It is an understandable connection between money becoming available, continuing obligations, later repayment and personal housing security. A signature can only be sensibly assessed on the basis of a contract that is actually understood and independently reviewed.
