A private house sale consists of many tasks. “Collect documents”, “create an advertisement” and “sign the contract” do not yet constitute a controllable process. You need a result for each phase by which it can be decided whether the next step is prepared. This article develops a bespoke editorial method for an Austrian sale. It is not a legally prescribed sequence and does not determine contractual deadlines.
First clarify the mandate to yourself
Write on one page what is to be sold, who decides about it and what outcome you want to achieve. Do ancillary areas and movable items belong to it? Should the house remain occupied until handover? Which personal appointments affect your availability? Record wishes initially as wishes.
Separate three objectives: the desired economic outcome, the possible timeframe and the conditions under which you can carry out the sale. If these objectives contradict each other, you need to make a decision before advertising. A very fast sale, still unresolved replacement accommodation and an immovable revenue expectation cannot be reconciled by a longer task list.
Structure the process by results
The following structure is our recommendation. A work package is only completed when its result is available; a sent request is not sufficient.
- Object of sale and participants – Tangible result: named units, uses and responsible persons; outstanding representation issues passed on; decision afterwards: Who can prepare or authorise which declaration?
- Property and supporting documents – Tangible result: comprehensible description with allocated documents and outstanding technical questions; decision afterwards: Which details can already be used?
- Economy and marketing – Tangible result: substantiated asking price, cost planning and chosen sales channel; decision afterwards: Is the launch desired under these conditions?
- Contacts and negotiation – Tangible result: shared level of information and complete proposal on price, scope and dates; decision afterwards: Which proposal should be legally drafted?
- Contract and execution – Tangible result: professionally accompanied process with confirmed prerequisites for payment, handover and registration; decision afterwards: Which next step is actually intended?
- Handover and completion – Tangible result: documented inventory, assigned outstanding settlements and personal completion folder; decision afterwards: Which remaining tasks still have a responsible person?
The table does not replace specialist examination. Its benefit lies in each step handing something usable to the next. A property description whose area basis is still unknown will not be passed on with a general tick “documents completed”.
Assign a person and a response for every open task
Note for a task the information required, the responsible person and the desired response date. “Contact bank” is too vague. Better: “Request from the bank, for the intended sale, date-related information on redemption and securities; monitor receipt and technical classification.” A request to the municipality likewise needs a concrete property and factual question.
Distinguish the person who obtains something from the person who assesses it technically. A family member can gather plans. That does not mean the proposed use has been examined under building law (baurechtlich). Coordination may openly state: document available, classification pending.
Not all milestones are the same event
In Austria the transfer of ownership in respect of immovable property is tied to the registration of the acquisition transaction in accordance with § 431 ABGB. A key appointment is therefore not a substitute for the legal transfer of title. [ABGB-431] Have the contract office explain the steps relevant to your sale and enter their actual prerequisites into the plan.
Documents may also be required earlier than a mere completion checklist would suggest. The basic rule of § 4 EAVG requires, in the case of covered sales, that the energy performance certificate be presented in good time before the contract declaration and handed over within 14 days after conclusion of the contract. [EAVG-4] An instruction “look for the energy performance certificate at the house handover” might be too late for that. Exceptions and existing older certificates must be examined separately.
An invented project status with a real decision
Mara wants to sell her house. She already has a photography appointment, but no definitive list of ancillary areas to be sold with it. Her brother is helping with the organisation; the conveyancing office is not yet aware of an open access question.
In the project plan the access becomes its own task. Mara obtains the existing deed, the conveyancing office classifies it, and the property description is then formulated accordingly. The photography appointment can take place once the scope of the photographs has been clarified. An unsecured statement about the access is not brought forward as a result. The decision concerns the specifically affected work package; the rest of the sale does not have to be mentally restarted from scratch.
Keep the current status brief but complete
Our recommendation for a regular review is: what has been confirmed since the last coordination, what is blocking a decision and what has changed? Note changed information where it is reused. A new handover idea, for example, may concern not only your calendar but possibly the contract draft and the clearance.
In the end you have a process in which every material decision has a recognisable basis. After the handover, also keep a list of the still outstanding settlements and their next steps. The sale is organisationally complete when these tasks have been processed or consciously handed over to the responsible party.
