Your loan still has a long fixed-interest period, and you want to check a possible change. The statement “After ten years I can get out” is too imprecise for that. The statutory point of reference and the further procedure must match the actual loan history. This article explains the preparation of a review under German law; it is not a notice of termination template and not an individual recommendation for refinancing.
Name the statutory route precisely
§ 489 paragraph 1 number 2 BGB concerns the ordinary termination of a loan with a fixed nominal interest rate: decisive are ten years since full receipt and a notice period of six months. A later new agreement on the repayment time or the nominal interest rate can, under the law, replace the point of reference. [BGB489]
The signature on the original contract is therefore not simply the same date as the legally designated full receipt. A later amendment must also be classified according to its content. The article does not decide solely on the basis of a file name whether a particular change has shifted the statutory point of reference.
Build a separate timeline for each loan component
Collect the contract version, disbursement history and later agreements. Note what the document actually proves. If several loans are involved in the property financing, do not mix their data into a single general line “loan start”.
For each component the following questions should be answerable: When was the full amount received according to the relevant history? Which later agreements were actually made? Which balance is to be redeemed at which time? Missing evidence should be marked as a gap and specifically queried.
Our editorial recommendation is to present this list to suitable advice for review. An online appointment calculated automatically is not sufficient confirmation if the actual disbursements or amendment agreements are missing from it.
Example: contract date and full receipt differ
A completely fictitious loan was first signed and then disbursed in several instalments. In a personal calendar only the day of signing is entered. In addition there is a later amendment whose significance has not yet been examined.
The borrower does not give notice based solely on this calendar entry. They compile the disbursement documents and the amendment and have the relevant history clarified. Only afterwards can a concrete timetable be assessed. The example deliberately contains no purportedly guaranteed end date, because precisely that still-open classification would be decisive.
Plan effectiveness and actual repayment together
A termination is not the entire redemption process. § 489 paragraph 3 BGB ties it to repayment within two weeks after effectiveness; if it does not occur, the termination is deemed not to have taken place. [BGB489] The required funds and the coordinated payment process therefore belong in the preparation.
Whether you repay from existing funds or use a follow-up financing must match the actual situation. A non-binding new offer should not be treated as an already secured inflow of funds. The parties involved clarify the redemption amount, payment and, if applicable, the handling of securities in the concrete case.
Do not put every early payment under the same heading
A contractually agreed additional partial payment, another statutory repayment route and the ordinary termination examined here must be distinguished from one another. Do not adopt any cost or deadline statement from another matter just because the word “redemption” appears everywhere.
Have the concrete legal basis and the actual procedure confirmed. This article does not quantify any prepayment penalty and does not claim universal cost-freeness of every bank switch. Even with an applicable statutory route, further questions about the new financing or processing may need to be examined.
In the end you need a coherent answer: the relevant loan history is documented, the legal classification has been made and the actual repayment is prepared for the resulting date. It is precisely this connection that protects against equating an abbreviated ten-year formula with a change already executable.
