A property management company or other professionally suitable support can take on a lot of work during a rental. Nevertheless, it should remain clear who only prepares matters and who makes binding decisions. If you say “Please take care of everything”, it is often still unclear in day-to-day life which tenancy agreement, which repair or which data disclosure is meant to be covered. A clearly defined mandate protects the joint process from contradictory expectations.
Describe tasks and legal representation separately
§ 1002 ABGB describes the power of attorney contract as the undertaking of an assigned business to be conducted in the name of another person. [VOLLM] Which specific authority your contract conveys and which special prerequisites apply to individual acts is therefore not conclusively clarified. A general description in conversation does not replace a suitable agreement.
Our editorial recommendation: First create a task list. This can include handling enquiries, organising appointments, collecting documents, preparing contracts and ongoing coordination. Write next to each whether an activity is only to be prepared or is to be carried out following a regulated approval procedure. Do not draft legal power of attorney texts off the cuff; have the necessary scope professionally tailored.
Price and contract content need clearly recognisable responsibility
Clarify who provides the legally and economically verified basis for the rental. A support function should not have to choose between various old price lists or unconfirmed contract templates. Note the valid version, its approval status and the person who resolves changes. A new file name alone does not prove professional approval.
A limit for deviations is particularly helpful. If an interested party requests a later rental start or an additional use, the support staff must know whether they may answer that question themselves. An internally established query route is an organisational proposal. The legal effect of a statement made externally depends on the actual agreements and circumstances.
Set more than one monetary limit for repairs
A cost ceiling can be sensible but is not sufficient for every case. Also clarify which type of measure may be commissioned, which information is required beforehand and how to proceed in the event of an acute danger. An urgent securing issue is different from a decision about a new kitchen fit-out.
Example, entirely fictitious: The support staff may organise a routine maintenance appointment. For a larger renewal recommended during that appointment they should first forward the findings, scope of work and quote. That is a different task from an immediate binding order. After the decision, the same file should show who approved which status and which result was confirmed later.
Align document access with actual need
The Data Protection Authority explains that personal data may only be processed within an appropriate legal framework and that data subject rights must be observed. [DSB] For your preparation this means: not every involved person must automatically receive all prospective tenant, contract and payment documents. Clarify the purpose, required data and appropriate accesses for the specific collaboration.
Appointment coordination does not necessarily need the same evidence as a contract review. Therefore do not introduce a freely accessible collective repository as the standard. Even if a support function could technically access a folder, the permissible and necessary scope should be specified separately. Legal roles and any required agreements belong in the appropriate data protection assessment.
Keep the outward communication channel simple
State which contact person is responsible for routine questions and how special cases are forwarded. Avoid owners and support staff sending different commitments at the same time. If you yourself agree an exception, the status required for further processing must arrive in good time. Personal details that are unrelated to tasks do not automatically belong in every message.
Finally, plan for absence and the end of the collaboration. Open cases, current versions and necessary evidence must be able to be returned or handed over. Careful delegation does not mean constantly double-checking every activity. It makes visible which decision lies where and where the next query belongs. Qualified advice is necessary for the concrete drafting of contracts and powers of attorney.
