You like the flat. You can imagine living here for many years, and the proposed loan instalment seems affordable. Before the first purchase, this promising starting point must become a complete project. You are acquiring a specific legal position and taking on responsibilities in a building whose communal situation is described not only by the condition of your future rooms.
First define what the flat must actually meet
Our editorial recommendation: Record a few indispensable requirements and test them against the specific offer. These may include everyday routes, room layout, access or a later alteration that will be needed. A wish for an extension that has not yet been checked remains a condition and is not counted as an existing room.
Note next to each crucial point the proof for it. Your own impression can explain your preference, but does not replace clarification of a legal or technical characteristic. If you consider a point fulfilled only because of a seller’s promise, that promise belongs precisely in the further examination.
Reserve your money only once
Compare the funds actually available with the total intended need. Record, alongside the purchase, the individual incidental costs, possible works, moving and the personal reserve you will still need. Separate confirmed amounts, financed items and still open estimates.
A bank statement must relate to the specific property and the actual conditions. Clarify the amount, required documents and disbursement conditions. The article does not recommend a loan-to-value ratio and does not confirm affordability; it helps to avoid allocating the same reserve both for the purchase payment and for a later emergency.
Check the flat together with the building
Request the ownership, contract and communal documents needed for the offer. Have legal unit, ancillary areas and the offered scope of use assigned. Supplement with the documented cost and decision status of the community as well as professionally relevant building information.
§31 WEG 2002 requires a reasonable reserve as provision for future expenses. [GEMEINSCHAFTSRUECKLAGE] That is a different level from your own bank balance. The existing reserve is not treated as freely available private purchase capital. Nor does its mere existence confirm that every conceivable work on the building is already financed.
Have the cost situation applicable to your flat explained. §32 Abs7 determines that the change of owner does not affect the allocation and unit rules set out there. [KOSTENUEBERNAHME] Therefore do not assume, merely because of your new purchase contract, that the distribution of communal costs can be freely re‑determined.
Make open points decidable before committing
Assign each material uncertainty to the appropriate examination. Building findings, legal use and loan disbursement are different tasks. A general “the documents are in order” should not replace the decisive concrete answer.
An early declaration also deserves scrutiny: submit offer, conditions, attachments and promised services in good time to contract advice. The detailed contract to come is not a clearance given here for prior obligations. What effect the specific declaration has will be assessed individually.
Fictional case: interior finished, building question open
A couple want to buy a freshly renovated flat. According to the first calculation the money is sufficient if the entire personal reserve is put into the purchase. Later both receive a notice of a still unresolved communal work.
They first have the actual investigation and decision status clarified. In the financing the remaining personal buffer is made visible. The couple then reassesses the whole project and not only the interior condition. The example does not assume either a necessary refurbishment or a specific funding need; it shows the effect of a previously omitted question.
Prepare the handover as a separate section
Coordinate the legal execution with the drawing up of the contract. §431 ABGB requires entry in the public register for the transfer of ownership. [EINVERLEIBUNG] For this reason purchase agreement, payment, key appointment and Einverleibung are explained as linked but distinct steps.
For the actual takeover rooms, keys, meters, existing documents and outstanding services are specifically documented. An unresolved promise should not be addressed for the first time only then. Keep the agreed version and the professional responses transparently.
Your final decision states the supporting reasons and all still material conditions. It can speak in favour of the purchase, demand further clarification or be against this offer. The first flat purchase can then be assessed when the living plan, total burden and handover route fit together.
