The seller's listing offers that you take over their supposedly favourable loan along with the house. That sounds attractive on paper. However, an existing interest rate does not automatically become your confirmed financing offer. First, debtor status, consent and concrete terms must be clarified.
Have house, charge and personal obligation explained separately
Explain openly to the bank and contract adviser what is intended: Are you to become the borrower in place of the previous person, assume joint liability in addition, or only make internal payments? These variants must be examined separately in legal and economic terms. An existing charge in the land register alone does not answer the question of personal obligation.
§1405 ABGB ties the entry of an assumer in place of the debtor to the creditor's consent. §1406 deals with the agreement with the creditor and, in case of doubt, treats the declared assumption as liability alongside the previous debtor. [SCHULD] [HAFTUNG] The article does not decide which arrangement actually exists in your draft.
The bank must confirm the specific model
Have outstanding debt, term, interest rules, securities and the proposed conditions of the takeover reviewed. Ask for the actual decision of the lending authority and its exact scope. An oral promise from the seller does not confirm an unchanged takeover of all conditions.
Also disclose whether other persons are jointly obliged or whether other properties serve as security. The review should capture the real contract, not a desired loan derived from a single monthly instalment. This article promises neither bank approval nor the release of previously liable persons.
Hypothetical case: The low interest conceals an additional obligation
A couple wants to settle part of the purchase price by taking over a loan. They compare only the previous nominal interest rate with a new offer. Only at the consultation does it become clear that the intended debtor status and the remaining conditions are not yet settled.
The couple therefore first clarifies the actual takeover route offered. They then compare complete payment and obligation schedules on the same basis. A single low interest rate is not a statement about total cost or the overall risk of the purchase.
Link purchase price and assumed debt in calculations
Our editorial recommendation: Show total consideration, immediate cash payment and any assumed obligation separately. Indicate the amount of the debt with its cut-off date. A reduced cash payment does not automatically mean that you economically expend only this reduced amount for the house.
If the bank does not confirm the takeover model, the purchase and financing plan must also be reassessed. Ask the contract adviser how this prerequisite is effectively dealt with in the transaction. An internal note “loan goes with it” does not constitute a reliable condition.
Compare only confirmed models
Your result should explain who is liable for what after the planned transaction, which consent exists and which payments together with conditions are actually foreseen. Compare this state only with an alternative financing. That way you assess the offered loan as a concrete obligation and not as advertising accessory to the house.
