You have been living in Austria for years and have found a suitable flat in Vienna. Whether you need a permit or a specific proof for the acquisition nevertheless does not follow solely from your registered address. For the preparation, nationality, the actual purchasers and the intended right are considered together. This article applies to Vienna; other federal states have their own land transfer rules.
Check residence and acquisition eligibility separately
The official Austria portal explains the basic equal treatment of EU and EEA nationals and at the same time points out regional legal rules as well as possible treaty-based exceptions. [UEBERBLICK] No uniform permit rule for every person throughout Austria is derived herefrom.
Our editorial recommendation: When preparing the contract, name all intended purchasers with their actual nationality and the planned acquisition share. A residence permit or a long period of residence is not simply treated as the same proof. Documents are provided for the specific examination purpose via the agreed appropriate route, not distributed as a precaution to everyone involved in a viewing.
What the Vienna law asks
The Vienna Foreigners' Land Acquisition Act (Ausländergrunderwerbsgesetz) covers in § 1 certain inter vivos acquisitions, including ownership, co-ownership and certain other rights in real property. § 2 defines the persons covered; for companies, not only the seat but also shareholdings can be decisive. [WIEN] A solely Austrian company address therefore does not automatically settle every acquisition check.
State which flat or land position and which right are actually to be acquired. A purchase of ownership and another land registry right are not planned as the same procedure merely because both are intended to enable future residence. The competent office classifies the specific acquisition and the proofs required for it.
Do not derive an exception from a family designation alone
§ 3 contains exceptions. These include, under the conditions described there, for example, joint acquisition by spouses or registered partners with an Austrian part and certain owner partnerships. The provision also names EU law and treaty bases. [WIEN]
The actual arrangement remains decisive. “My partner is Austrian” does not automatically answer every question in the case of an intended sole acquisition. Likewise, an assessment for a certain purchaser structure is not used unchanged if another person or company is added shortly before the contract. Report such changes early so that the classification has the same status as the draft contract.
Distinguish between permit and negative confirmation
A permit concerns the approval of an acquisition subject to approval. A negative confirmation, by contrast, certifies under the statutory conditions that a permit is not required. § 5 paragraph 4 regulates the written confirmation on request for the exceptions specified there. [WIEN] It does not follow that every exempt person automatically requires every conceivable additional procedure.
Have clarified for the concrete registration which proof actually has to be provided. An already promised financing and a planned move-in date do not replace this clarification. At the same time, the application for a confirmation is not documented as an already legally binding acquisition permit.
Example: A joint plan becomes a sole acquisition at short notice
In the fictitious case, a couple prepare a joint flat purchase in Vienna. Later, only one person is to acquire. However, the previous assessment was based on the joint model and the information submitted for it.
The next sensible step is to coordinate the change with the contract preparation and, where appropriate, the competent authority. The example does not decide a permit requirement or an exception. It shows why personal relationship, acquisition share and the actually planned right to be acquired must be considered together.
Organise the check before binding declarations
Record the required classification, existing proofs and remaining open authority questions in a short overview. Ask the contract drafter to explain how a possible permit reservation and the further procedure for your specific case are to be designed. This article does not provide a ready-made clause and does not guarantee any processing time.
If a permit is required, its prerequisites are examined on the basis of the actual project. A secure success is not derived from general information or someone else's closed case. In the end, the purchase contract, financing planning and proof of acquisition should use the same clarified status. In this way, the question of the passport becomes a timely processed prerequisite of the concrete Vienna property purchase.
