A network operator is offering you, as the building owner, a fibre-optic expansion. The costs are to be treated as a provision fee (Bereitstellungsentgelt) and later covered via the rent statement. Before consenting you need a complete contract comparison. A promoted possibility to allocate costs is not yet a demonstrated payment and operating plan for your building.
Recognise the specific scope of services
§ 72 TKG describes an agreement between the network operator and the property owner for the initial provision of the fibre-optic infrastructure described there, its connection and the guaranteed operational readiness during the agreed phase. [TKG] Clarify whether the submitted offer follows exactly this route and which parts of the installation are actually covered.
Do not confuse the owner contract with the individual internet services of the residents. For the relevant operating cost item § 2 number 15c BetrKV requires, among other things, the tenant's free choice of provider. [BETRKV] A general expansion promise alone does not satisfy this requirement.
Lay out costs and timeframe completely side by side
Under § 72 the fee is at most 60 euros per year and at most 540 euros in total per residential unit. The collection period is in principle limited to up to five years; under the statutory conditions up to nine years are possible. Third-party cost contributions and public subsidies are to be deducted from the cost base. [TKG]
Our editorial recommendation: Require that the offer clearly shows the fee, total costs and the start and end of the period. Which actually constructed passive infrastructure is financed by the amount? Which other financiers were taken into account? A low monthly amount leaves the overall scope and possible further contractual obligations open.
The statute contains a construction cut-off date of 31 December 2027 and special rules for older infrastructures. [TKG] An indeterminate construction plan is therefore not treated as an already appropriately classified installation.
Put the economic comparison before committing
§ 556 paragraph 3a BGB ties the bearing of rental costs to the economic implementation. For an elaborate measure the provision requires, where possible before agreement, obtaining three offers and selecting the most economical. § 72 designates total costs over 300 euros per residential unit as an elaborate measure and requires a justification from the network operator. [MIETE, TKG]
Compare the same service with the same time and obligation framework. If offers are missing or different scopes are stated, this gap must be clarified before accepting the contract. Compliance with a statutory maximum amount does not automatically replace the concrete economic comparison.
Also assess the later owner obligations
After the provision period the owner must ensure the operational readiness of the in-building infrastructure. The statutory duty to grant permanent access to other providers then also affects the owner. [TKG] Therefore plan for the later contact person and the practical management of this task.
In the hypothetical case Elena initially focuses on the advertised annual charge. In the comparison she notices that one offer hardly explains the later operation. She has this section and the access for other providers specified. The earlier total price comparison is then repeated with the same clarified scope of services.
Decide only with the complete picture
The result combines the checked expansion scope, cost base, economic viability, timetable, provider access and follow-up. The concrete allocation agreement and the owner contract are professionally reviewed before commitment. Technical execution and structural prerequisites remain to be clarified separately.
With this information you can assess the actual offer. The guide does not confirm any specific investment nor a guaranteed full refinancing through tenants.
