Do not infer the designation from the transfer reference
§908 ABGB describes Angeld as an amount given in advance at the conclusion of a contract which, absent a special agreement, serves as a sign of conclusion or as security for performance. The provision governs the consequences of culpable non-performance and differs from an ordinary deposit. [ANGELD] Which case applies to your payment must be determined from the concrete agreement.
Please therefore first ask the contract advisory service to clarify whether a binding agreement already exists and what function the amount has within it. A self-chosen booking text does not transform an unresolved payment into the desired security. The amount alone also does not answer the legal classification.
Repayment and free withdrawal are different questions
The statutory framework of Angeld does not automatically mean that either party can withdraw at will without loss or return of the amount. §908 names, alongside the treatment of Angeld, further statutory options for the innocent party. Agreed Reugeld is treated separately in §909 with its own rescission function and limits. [ANGELD] [REUGELD]
Therefore have it explained what should happen for what reason in the event of non-performance. What applies where a condition validly agreed is met, where non-performance is caused by one party, and where the cause is otherwise unclear? This article does not provide a clause and does not promise a general free right of withdrawal.
Hypothetical case: one amount, three expectations
A purchaser is to pay 8.000 Euro. She understands this as money held provisionally which she will receive back if financing fails. The vendor side regards it as Angeld for an already concluded deal. Another involved person merely calls it a reservation.
The purchaser clarifies the entire agreement and the recipient with the contract advisory service before transfer. The three different terms remain visible as a contradiction until then. The invented amount is neither a recommended level nor a statement about the appropriateness of a particular Angeld.
The payment method must also fit the clarified agreement
Our editorial recommendation: Have recorded who receives the amount on whose instruction, when it may be used and how a later crediting or repayment is to be handled. A payment to a private account and a concretely agreed escrow arrangement must not be treated as equivalent security without verification.
Check the released payment details via the known contact at the responsible office. An urgent new message shortly before the transfer is no substitute for clarifying the instruction. This organisational precaution does not assess the validity of the purchase transaction.
Your result before payment should be simple: you understand the contractual status, the purpose of the amount, its possible crediting and the professionally explained consequences of non-performance. If these basics are missing, a quick transfer does not make the transaction more comprehensible.
