A letter from a preservation (Erhaltungs) procedure arrives. The repair has already been an issue in the building for some time; a company has now offered an inspection appointment. Before you file the case away as on the way to completion, you must clarify what the letter actually requires and whether the service you plan fulfils that content.
Read the procedural status before the appointment list
Lay out the complete order together with the proof of delivery and attachments. Have it clarified by a specialist which decision exists, whether it is final, which deadline applies and which steps may or must still be carried out within that deadline. Your own calendar note from a telephone summary is not sufficient for this.
§ 6 MRG provides within its scope for an order to carry out omitted maintenance or improvement works within an appropriate, at most one-year period; for certain priority works it contains special rules. Match the order and the actual scope of services
Transfer the required results into an internal work overview. Alongside these list the technical services provided for them, open queries and the responsible contractor. If the inspection appointment serves only for diagnosis, mark it as diagnosis. It is not yet an execution of the ordered work.
Have it explained whether a proposed partial step actually achieves the required scope. A new coat of paint would not be a factual completion of another, still unresolved cause. Translate the deadline backwards into work steps
Our editorial recommendation: Plan backwards from the required completion and evidence status. Before that come execution, material availability, binding commissioning and, where applicable, a technical preliminary check. Do not enter just the first available tradesperson appointment. Ask for the entire realistic sequence.
If a delay becomes apparent, submit it immediately to the legal and technical support. An internally changed date line does not change the order. Even a friendly discussion between the parties is not automatically an effective change of the applicable deadline. Which adjustment is legally possible must be clarified concretely.
Hypothetical case: inspection done, order still open
The owner of a rental building reports that the company has already been there. On inquiry, however, it has only taken photos and announced an offer. The internal status therefore remains: inspection carried out, offer and execution pending.
He compares the remaining time with delivery and execution. The engaged specialist defines the required scope of work. Only the actually confirmed procedure is communicated to the residents. Only after execution are the technical feedback and the documentation required in the procedure consolidated.
Why the completion should be explicitly checked
Under § 6 paragraph 2 a final order is an enforcement title. After the unsuccessful expiry of the specified deadline, and under the statutory conditions, the appointment of an administrator for execution and financing can be applied for. Collect at the end proof of performance, technical results and outstanding points. Have clarified which communication or which proof is required in the specific procedure. A paid quote, an invoice or mere feedback from an appointment person do not necessarily prove that the order has been fully fulfilled.
